Danville Planning Commission – Regular Meeting Summary of Actions - Draft April 25, 2023 1. CALL TO ORDER The regular meeting of the Danville Planning Commission was called to order by Chair Radich at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Archie Bowles, Commissioner Robert Combs, Commissioner Mary Grace Houlihan, Commissioner Ken Mintz, Commissioner Lou Palandrani, Commissioner Chris Trujillo, Chair Mark Graham, Vice Chair Paul Radich, Chair 2. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Chief of Planning, David Crompton advised the Commission that the supplemental memo that was handed out prior to the meeting will be addressed during item number 5.1. 3. FOR THE GOOD OF THE TOWN There were no public comments. 4. CONSENT ITEMS 4.1 Consider approval of the Summary of Actions from the regular Planning Commission meeting of March 28, 2023 Chair Radich opened the item to public comment. MOTION BY COMMISSIONER COMBS, SECOND BY COMMISSIONER HOULIHAN TO APPROVE THE SUMMARY OF ACTIONS FROM THE MARCH 28, 2023, PLANNING COMMISSION REGULAR MEETING MOTION CARRIED 7-0-0-0 5. PUBLIC HEARINGS 5.1 Consider approval of Resolution No. 2023-07, recommending that the Town Council approve Rezoning request PUD23-0001 to rezone two parcels with a General Plan Land Use Designation of Residential - Rural Residential from A-2; General Agricultural District to P-1; Planned Unit Development District to allow for the establishment of zoning standards that are consistent with the surrounding neighborhood (Project Planner: Riley Anderson-Barrett) Associate Planner Riley Anderson-Barrett presented the staff report. Ms. Anderson-Barret and David Crompton, Chief of Planning answered questions from the Commissioners. Robert Legg, applicant explained the reason for this rezoning request and answered Commissioner’s questions. Chair Radich opened it up to public comment. The following two speaker cards were received from the public that did not wish to speak but to register their opinion in opposition of this item: • Lisa Bearchemin, Danville Resident • Carmen Curtis, Danville Resident Vicki Fischer, Danville resident, is opposed to this rezoning request. Ms. Fischer expressed concern over limited access to the two parcels. George Cowen, Danville resident, is not opposed to the rezoning but is in opposition of more building. He is concerned about the water runoff. Chair Radich closed the item to public comment. Mr. Crompton and Ms. Anderson-Barrett answered additional questions from the Commission. MOTION BY COMMISSIONER GRAHAM, SECOND BY COMMISSIONER TRUJILLO, TO APPROVE RESOLUTION NO. 2023-07, RECOMMENDING THAT THE TOWN COUNCIL APPROVE REZONING REQUEST PUD23- 0001 TO REZONE TWO PARCELS WITH A GENERAL PLAN LAND USE DESIGNATION OF RESIDENTIAL-RURAL RESIDENTIAL FROM A-2; GENERAL AGRICULTURAL DISTRICT TO P-1; PLANNED UNIT DEVELOPMENT DISTRICT TO ALLOW FOR THE ESTABLISHMENT OF ZONING STANDARDS THAT ARE CONSISTENT WITH THE SURROUNDING NEIGHBORHOOD MOTION CARRIED 5-2-0-0; COMMISSIONERS BOWLES AND HOULIHAN OPPOSED 5.2 Consider approval of Resolution No. 2023-05, recommending that the Town Council approve Zoning Text Amendment ZTA23-0001 to amend the Town’s Single Family Residential District, Two Family Residential District, and Multifamily Residential District Ordinances as necessary to comply with State law and provide other minor revisions (Project Planner: Riley Anderson-Barrett) Ms. Anderson-Barrett presented the staff report. Ms. Anderson-Barret and Mr. Crompton, answered questions from the Commissioners. Chair Radich opened the item for public comment. There were no public comments. MOTION BY COMMISSIONER HOULIHAN, SECOND BY COMMISSIONER GRAHAM TO APPROVE RESOLUTION NO. 2023-05, RECOMMENDING THAT THE TOWN COUNCIL APPROVE ZONING TEXT AMENDMENT ZTA23-0001 TO AMEND THE TOWN’S SINGLE FAMILY RESIDENTIAL DISTRICT, TWO FAMILY RESIDENTIAL DISTRICT, AND MULTIFAMILY RESIDENTIAL DISTRICT ORDINANCES AS NECESSARY TO COMPLY WITH STATE LAW AND PROVIDE OTHER MINOR REVISIONS Danville Planning Commission – Regular Meeting Summary of Actions - Draft May 9, 2023 4 MOTION CARRIED 7-0-0-0 5.3 Consider approval of Resolution No. 2023-06, recommending that the Town Council approve Zoning Text Amendment ZTA23-0002 to amend the Town’s Accessory Dwelling Unit Ordinance as necessary to comply with State law (Project Planner: Riley Anderson-Barrett) Ms. Anderson-Barrett presented the staff report and answered Commissioner’s questions. Mr. Crompton explained the supplemental memo that was passed out prior to the beginning of the meeting and answered Commissioner’s questions. Chair Radich opened the item for public comment. There were no public comments. MOTION BY COMMISSIONER COMBS, SECOND BY COMMISSIONER PALANDRANI TO APPROVE RESOLUTION NO. 2023-06, RECOMMENDING THAT THE TOWN COUNCIL APPROVE ZONING TEXT AMENDMENT ZTA23-0002 TO AMEND THE TOWN’S ACCESSORY DWELLING UNIT ORDINANCE AS NECESSARY TO COMPLY WITH STATE LAW AND TO ALLOW THE CHIEF OF PLANNING TO INCLUDE THE PARTS NEEDED FROM THE MEMO SUBMITTED, RELATED TO ALLOWING A SECOND CONVERTED SPACE ADU IN EACH SINGLE FAMILY RESIDENCE, AS SUPPLEMENTAL MATERIAL INTO THIS RECOMMENDATION MOTION CARRIED 7-0-0-0 6. COMMUNICATIONS 6.1 Commissioner and Staff Reports Commissioner Palandrani spoke about the Planning Commissioners Academy. Commissioner Palandrani, Commissioner Houlihan, and Commissioner Combs attended. Commissioner Palandrani thanked the Town for giving him the opportunity to attend.
