SUBJECT: Resolution No. 26-2023, approving the Town’s inventory of owned and
leased properties pursuant to Government Code Section 50569 and
identifying any surplus land pursuant to Government Code Section 54230
BACKGROUND
Government Code Section 50569, part of the Surplus Lands Act, requires all local
government agencies to prepare an annual inventory of all real property owned or
controlled by the agency to determine whether any of that property is “in excess of its
foreseeable needs.” Government Code Section 54230, also part of the Surplus Lands Act,
requires agencies to make an annual inventory of “all surplus land” owned by the agency.
Section 54230 then requires each agency to report to the Department of Housing and
Community Development (“HCD”) all properties identified as either in excess of
foreseeable needs or surplus.
DISCUSSION
The attached inventory (Exhibit 1 to Resolution No. 26-2023) lists all properties owned by
the Town as of December 31, 2022 (no properties have been added or deleted since that
time). The Town does not lease any properties. At this time, the Town does not own any
property that is either “in excess of its foreseeable needs” or is surplus, as defined in the
Government Code. This fact was reported to HCD as part of the Housing Element Progress
Report for 2022, recently approved by the Town Council.

RECOMMENDATION
Adopt Resolution No. 26-2023, approving the Town’s inventory of owned and leased
properties pursuant to Government Code Section 50569 and identifying any surplus land
pursuant to Government Code Section 54230.

RESOLUTION NO. 26-2023
APPROVING THE TOWN’S INVENTORY OF OWNED AND LEASED
PROPERTIES PURSUANT TO GOVERNMENT CODE SECTION 50569 AND
IDENTIFYING ANY SURPLUS LAND PURSUANT TO GOVERNMENT CODE
SECTION 54230
WHEREAS, Government Code Section 50569, part of the California Surplus Lands Act, requires
all local government agencies in the state to annually prepare an inventory of real property
owned or leased by the agency and to further identify whether any of those properties are “in
excess of its foreseeable needs”; and
WHEREAS, Government Code Section 54230, also part of the Surplus Lands Act, requires every
local agency to identify any properties owned or leased by the agency which are “surplus” as
defined in the Government Code and to report any properties identified as either in excess of
foreseeable needs or surplus to the Department of Housing and Community Development; and
WHEREAS, the Town has prepared the required inventory, which is attached to this resolution
as Exhibit 1 and incorporated by this reference; and
WHEREAS, none of the properties identified in the inventory are in excess of the Town’s
foreseeable needs nor surplus; now therefore be it
RESOLVED, that the Danville Town Council hereby approves the attached inventory of real
property owned or leased by the Town and finds that the Town has no properties in excess of
its foreseeable needs or surplus.
