SUBJECT: Resolution No. 24-2023, authorizing the posting of prima facie speed
limits on portions of various streets within the Town of Danville
BACKGROUND
The California Vehicle Code prescribes the manner in which local jurisdictions may post
reduced prima facie speed limits upon their roadways. "Prima facie" speed limits are
those other than the maximum speed limits set by the State legislature that are "on the
face of it" reasonable and prudent under normal driving conditions. Prima facie speed
limits are established upon the basis of a traffic and engineering survey to determine if
the speed limit of 65 miles per hour is more than reasonable or safe upon any local
roadway, and where local authority may, by ordinance, determine and declare a local
speed limit that is appropriate to facilitate the safe and orderly movement of traffic.
In keeping with the requirements outlined within the California Vehicle Code, every
street section where prima facie speed limits are enforced must have a traffic and
engineering survey conducted every five or seven years to justify the posted speed limits.
Resolution No. 24-2023 lists street segments that have been resurveyed to meet the state -
mandated time requirement.
DISCUSSION
Traffic and engineering surveys revealed that the prima facie speed limits currently
posted on the street sections listed within Resolution No. 24-2023 continue to best serve
those streets. Assessments of traffic speed patterns, roadside conditions, and accident
histories support the current posted prima facie speed limits in all instances. Therefore,
no speed limit changes are being proposed on any of the street segments listed in this
resolution.

RECOMMENDATION
Adopt Resolution No. 24-2023, authorizing the posting of prima facie speed limits on
portions of various streets within the Town of Danville.

RESOLUTION NO. 24-2023
AUTHORIZING THE POSTING OF PRIMA FACIE SPEED LIMITS
ON PORTIONS OF VARIOUS STREETS WITHIN THE TOWN OF DANVILLE
WHEREAS, the street sections listed below are maintained by the Town of Danville; and
WHEREAS, the Danville Town Council resolves that, on the basis of individual traffic
and engineering surveys, the maximum speed limit of 65 miles per hour (as indicated in
Section 22349, "Maximum Speed Limit Law' of the California Vehicle Code) upon the
following street sections is more than is reasonable or safe; and,
WHEREAS, the prima facie speed limits declared by this resolution will facilitate the
orderly movement of traffic in a reasonable and safe manner; now, therefore, be it
RESOLVED by the Danville Town Council that pursuant to Sections 22357 and 22358 of
the California Vehicle Code, the following prima facie speed limits are established:
