Town Council – Regular Meeting and Closed Session SUMMARY OF ACTIONS March 7, 2023 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Boy Scout Troop 1630, Danville, Shaurya Chauhyan. 3. CHANGES TO THE ORDER OF THE AGENDA Town Manager Joe Calabrigo recommended the following changes to the order of the agenda: move item 5.1 to follow item 3; and, move item 8.1 to follow item 5.3. 5.1 Presentation by California State Assemblymember Rebecca Bauer-Kahan MOVED TO FOLLOW ITEM 3 Assemblymember Rebecca Bauer-Kahan presented the Town with a check in the amount of $500,000 for the Town’s fiber optic project to extend the technology through Danville. 4. FOR THE GOOD OF THE TOWN Mary Ann Peters expressed concern regarding the future placement of affordable housing in Danville. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 7, 2023 Christopher Cross expressed concern regarding the need to notify motorists travelling on Diablo Road in advance of roadwork in the area and suggested that the Town opt to elect Councilmembers by districts. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation by California State Assemblymember Rebecca Bauer-Kahan MOVED TO FOLLOW ITEM 3 5.2Presentation of a proclamation to Larry Fong, Red Cross External Relations Liaison, proclaiming March 2023 American Red Cross Month Mayor Storer presented the proclamation. 5.3Reading of a proclamation by Mayor Storer proclaiming March 2023 Women’s History Month Mayor Storer read the proclamation. 8.1 MCE Clean Energy update and highlight on key products and services by JB Ackemann, MCE Director of Public Affairs MOVED TO FOLLOW ITEM 5.3 JB Ackemann, MCE Director of Public Affairs, provided the update and responded to questions from the Town Council. 6. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of February 21, 2023 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 17-2023, appropriating funds and authorizing the purchase of one Police Patrol Vehicle to replace an existing patrol vehicle that is not roadworthy and too costly to repair 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 7, 2023 6.4Consider adoption of Resolution No. 18-2023, reconfirming and extending the existence of a local emergency 6.5Consider adoption of Resolution No. 19-2023, approving the naming of the Community Room at 500 La Gonda Way 6.6Consider adoption of Resolution No. 20-2023, designating the District Engineer, directing preparation of the annual report for fiscal year 2023/24 for the Danville Street Lighting and Landscape Assessment District 1983-1 and approving a contract extension with Francisco & Associates 6.7Consider adoption of Resolution No. 21-2023, awarding a construction contract and transferring funds from CIP No. C-610 Pavement Management to CIP No. C-601 Camino Ramon Improvements MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo Joe Calabrigo provided the report and introduced Emergency Services Manager Nate McCormack. 8. COMMUNICATIONS 8.1MCE Clean Energy update and highlight on key products and services by JB Ackemann, MCE Director of Public AffairsMOVED TO FOLLOW ITEM 5.3 8.2Quarterly Danville Police Department Report and introduction of new Police Department personnel by Police Chief Allan Shields Chief Shields provided the report and introduced new personnel. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 7, 2023 8.3Recruitment announcement by City Clerk Marie Sunseri for positions open to Danville residents interested in volunteering. Term begin July 1, 2023: a.Poet Laureate: one position, two-year term b.Arts Advisory Board: two regular members, four-year terms c.Arts Advisory Board: one youth member, two-year term d.Senior Advisory Commission: three regular members, four-year terms e.Parks, Recreation and Arts Commission youth representative: one youth representative, two-year term f.County Connection Citizens’ Advisory Committee: one representative, two-year term g.Contra Costa County Advisory Council on Aging: one representative, two-year term City Clerk Marie Sunseri made the announcement. 9. TOWN COUNCIL REPORTS 9.1Danville Area Chamber of Commerce liaison report by Mayor Storer and Vice Mayor Stepper Mayor Storer and Vice Mayor Stepper provided the report. 9.2RecycleSmart Boardmember report by Councilmembers Arnerich and Morgan Councilmembers Arnerich and Morgan provided the report. 9.3Town Council updates Councilmembers provided updates on events and activities in Danville. 10. ADJOURN TO CLOSED SESSION The regular meeting of the Danville Town Council was adjourned to a publicly noticed closed session at 7:13 p.m. Councilmember Fong recused himself from the closed session due to a conflict of interest due to prior work for one of the settling defendants and vacated the building. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 7, 2023 11. CLOSED SESSION 11.1Closed Session conference with legal counsel - Existing Litigation (Section 54956.9(a)) Name of Case: National Opioid Litigation Settlements: Teva, Allergan, Walmart, Walgreens and CVS Settlements 11.2Report on Closed Session Mayor Storer reported out of closed session that the Town Council unanimously directed the City Attorney to take steps to have the Town opt into the proposed class action settlements. 12.
