CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by David Miller. 3. CHANGES TO THE ORDER OF THE AGENDA Town Manager Joe Calabrigo stated that a revised report and resolution was distributed for item 9.2. Item 9.3 has been incorporated into 9.2 and removed from the agenda. 4. FOR THE GOOD OF THE TOWN Mayor Storer stated that there was correspondence received by the Town and provided to the Town Council in advance of the meeting from: Katherine Walley Douglas Leich Sarah Stroin Stephanie Taddeo requested that the Town Council declare March 8 as Tyrell Wilson Remembrance Day and February 9 as Laudemer Arboleda Remembrance Day. She also requested that the Town establish a permanent memorial for each of them. Chuck Preas expressed opposition to the pickleball courts proposed for Osage Station Park. 5. PRESENTATIONS AND PROCLAMATIONS 5.1 Reading of a proclamation by Mayor Storer recognizing February 2023 as American Heart Month Mayor Storer read the proclamation. 6. CONSENT CALENDAR 6.1 Consider approval of the Summary of Actions from the special Town Council meeting of January 17, 2023 6.2 Consider approval of the Summary of Actions from the regular Town Council meeting of February 7, 2023 6.3 Consider approval of the Register of Demands 6.4 Consider acceptance of the December 2022 Month End Treasurer's Report 6.5 Consider adoption of Resolution No. 8-2023, awarding a professional services agreement for project management services for the Fiber Optic Interconnect, CIP A-620 6.6 Consider adoption of Resolution No. 9-2023, terminating the declaration of a local emergency within the Town of Danville related to the COVID-19 pandemic 2 DocuSign Envelope ID: 7FC61 E3D-A14B-440E-8825-428279D5616E DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 21, 2023 MOTION BY COUNCILMEMBER MORGAN, SECOND BY VICE MAYOR STEPPER, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 7. COMMUNICATIONS 7.1 Legislative update by Management Analyst Cat Bravo Cat Bravo provided the report. 8. PUBLIC HEARINGS 8.1 Consider adoption of Resolution, 10-2023, re -adopting the Town's 2023- 2031 Housing Element of the General Plan GPA22-0001 Mayor Storer stated that two members of the Town Council have conflicts of interest on some of the potential sites and those will be addressed when we reach that portion of the presentation. Chief of Planning David Crompton presented the staff report. City Attorney Rob Ewing explained the next step in the process which addresses potential conflicts of interest that two councilmembers have with a handful of sites identified in the Housing Element and added that this is the same process the Town used for the public hearing on January 17, 2023. Conflict rules developed by the Fair Political Practices Commission (FPPC) allow for a process called segmentation. Under that process, the members of the Council without a conflict can consider and vote on the sites with the conflicted councilmember abstaining. Once a vote is taken on those sites, then the entire Council can move forward and consider the rest of the Housing Element and related actions without further discussion of the conflicted sites. Councilmember Arnerich recused himself from this item and departed the meeting room. 3 DocuSign Envelope ID: 7FC61 E3D-A14B-440E-8825-428279D5616E DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 21, 2023 Mr. Ewing explained that the conflict is that Councilmember Arnerich's residence is within either 500 or 1,000 feet of the following three sites on the list: R1 (the Wells Fargo Bank at the corner of San Ramon Valley Blvd and Town and Country Drive), R2 (the Town & Country Shopping Center) and S (the Village Shopping Center). Mayor Storer open the public hearing to anyone wishing to speak to any of those three sites. There were no speakers. Mayor Storer closed this portion of the public hearing. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER FONG, TO INCLUDE SITES R1, R2 AND S IN THE READOPTED HOUSING ELEMENT MOTION CARRIED 4-0-0-1; COUNCILMEMBER ARNERICH ABSENT Councilmember Arnerich returned to the dais. Mayor Storer recused himself from this discussion and departed the meeting room. Vice Mayor Stepper presided over the meeting. Mr. Ewing explained that the conflict of interest is that Mayor Storer has an ownership interest in the apartment building at 1011 Hartz Way, which is within 500 of Site N (the Crossroads Shopping Center, 480 and 486 San Ramon Valley Blvd.) on the list. Vice Mayor Stepper opened the public hearing to anyone wishing to speak to this site only. There were no speakers. Mayor Storer then asked if there are any other questions from the Town Council that don't involve those 4 sites. Mayor Storer opened the public hearing to anyone wishing to speak to anything about the housing element other than the four sites. MOTION BY COUNCILMEMBER MORGAN, SECOND BY VICE MAYOR STEPPER, TO ADOPT RESOLUTION NO. 10-2023, RE -ADOPTING THE TOWN'S 2023-2031 HOUSING ELEMENT OF THE GENERAL PLAN GPA22-0001, INCLUDING THE EARLIER MOTIONS REGARDING SITES N, R1, R2 AND S MOTION CARRIED 5-0 9. ADMINISTRATIVE STAFF REPORTS 9.1 Consider adoption of Resolution No. 11-2023, authorizing Community Events Street Closures or Parking Restrictions for Calendar Year 2023; and Resolution No. 15-2023, authorizing Exemption from Danville Ordinance No. 96-10 for the Ridge Hike for Prevention on April 30, 2023 Special Events Specialist Lianna Adauto presented the staff report and stated that the Town received correspondence from David Miller and it was distributed to the Town Council prior to the meeting. Ms. Adauto responded to questions from the Town Council. Mayor Storer opened the item to public comment. Mayor Storer closed the item to public comment. Kent Screechfield, Kiwanis Club of San Ramon Valley, provided additional information on the Fourth of July Parade at the request of the Town Council. There was Town Council consensus to close Hartz Avenue to Railroad Avenue and grant the request to close streets at 6:00 a.m. The meridian barricades will be shifted north to the intersection of Hartz and Railroad Avenue. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY VICE MAYOR STEPPER, TO ADOPT RESOLUTION NO. 11-2023, AUTHORIZING COMMUNITY EVENTS STREET CLOSURES OR PARKING RESTRICTIONS FOR CALENDAR YEAR 2023; AND RESOLUTION NO. 15-2023, AUTHORIZING EXEMPTION FROM DANVILLE ORDINANCE NO. 96-10 FOR THE RIDGE HIKE FOR PREVENTION ON APRIL 30, 2023; INCLUDING TWO CHANGES TO THE HOT SUMMER SUNDAY CAR SHOW: CLOSING HARTZ AVENUE UP TO RAILROAD AVENUE; AND, GRANTING THE REQUEST TO CLOSE STREETS AT 6:00 A.M. MOTION CARRIED 5-0 9.2 Consider adoption of Resolution No. 12-2023, accepting the mid -year Financial Report, approving mid -year adjustments to the Fiscal Year 2022/23 Operating Budget; and Resolution No. 13-2023, accepting the mid- year Financial Report, approving mid -year adjustments to the Fiscal Year 2022/23 Capital Improvement Program Town Manager Joe Calabrigo and Finance Director/Treasurer Lani Ha presented the staff report. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO ADOPT RESOLUTION NO. 12-2023, ACCEPTING THE MID -YEAR FINANCIAL REPORT, APPROVING MID -YEAR ADJUSTMENTS TO THE FISCAL YEAR 2022/23 OPERATING BUDGET; AND RESOLUTION NO. 13-2023, ACCEPTING THE MID -YEAR FINANCIAL REPORT, APPROVING MID -YEAR ADJUSTMENTS TO THE FISCAL YEAR 2022/23 CAPITAL IMPROVEMENT PROGRAM MOTION CARRIED 5-0 9.3 Consider adoption of Resolution No. 14-2023, appropriating a $35,000 Mid - Year Budget Adjustment for Housing Element Outreach REMOVED FROM THE AGENDA 9.4 Consider adoption of Resolution No. 16-2023, authorizing an Emergency Storm Drain Culvert Replacement contract pursuant to California Public Contract Code Sections 20168 and 22050 and appropriating additional funding for Town -wide Storm Drain System Management, CIP No. A-330 City Engineer Steven Jones presented the staff report and stated that the project is exempt from CEQA requirements.
