Town Council – Regular Meeting SUMMARY OF ACTIONS February 7, 2023 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Mayor Storer. 3. CHANGES TO THE ORDER OF THE AGENDA Town Manager Joe Calabrigo stated that item 6.5, Ordinance No. 2023-03, will be removed from the consent calendar for separate votes in order to address potential conflicts of interest. 4. FOR THE GOOD OF THE TOWN Public comment was received from Andrea Nickels prior to the meeting and distributed to the Town Council regarding the process to add pickle ball courts to Osage Station Park. Rick Ochoa expressed opposition to the pickle ball courts proposed for Osage Station Park. Kalisa Larue expressed opposition to the pickle ball courts proposed for Osage Station Park. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 7, 2023 Carol Hurley expressed concern regarding the change in location and lack of amenities for the Senior Bridge Group. Maryann Peterson expressed concern regarding the treatment of the Senior Bridge Group. Gabriel Yuen expressed concern regarding Town response to the recent floods in the Everett Drive and Greenbrook neighborhood and asked for the Town to address and support the affected residents. David Bonnie expressed concern regarding Town response to the recent floods in the Everett Drive and Greenbrook neighborhood and asked the Town Council to take action to prevent flooding in the future. Rachel Medrano expressed concern regarding the recent floods and asked the Town to address and support the affected residents. Anthony Romanelli expressed concern regarding the recent floods and expressed support for an investigation into how it could have been prevented. He also expressed opposition to the pickle ball courts proposed for Osage Station Park. J.D. Nees expressed concern regarding the recent floods and asked the Town to address and support the affected residents. Chuck Preas expressed opposition to the pickle ball courts proposed for Osage Station Park. Diane Preas submitted a speaker card in opposition to the pickle ball courts proposed for Osage Station Park. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Reading of a proclamation by Mayor Storer recognizing February 2023 as Black History Month Mayor Storer read the proclamation. 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 7, 2023 5.2Presentation of a proclamation to Noya Lee, Principal of Bay Valley Chinese School, recognizing the Lunar New Year Mayor Storer presented the proclamation. 6. CONSENT CALENDAR Ordinance No. 2023-03 was removed for a separate vote. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of January 10, 2023 6.2Consider adoption of Resolution No. 6-2023, approving quitclaim deeds vacating excess street right-of-way, located at 1631 Lawrence Road, APN 206-170-004 and 1641 Lawrence Road, APN 206-170-005 6.3Consider approval of the Register of Demands 6.4Consider acceptance of the November 2022 Month End Treasurer’s Report 6.5Consider adoption of Ordinance No. 2023-01, adding Sections 32-45.21.2, 32-45.28, 32-45.29 and 32-45.48 to the Danville Municipal Code to add a New Area 13 to the Downtown Business District allowing Multifamily Residential-High Special Development and Establishing Development Standards and Submittal Requirements for Such Projects and Amending Sections 32-45.1, 32-45.3.D and 32-45.10 to Make Conforming Changes to the Downtown Business District; Ordinance No. 2023-02, amending Section 32-20.3 of the Danville Municipal Code to add an M-35 Zoning District and adding a New Section 32-29 to the Danville Municipal Code Establishing Standards and Processing Requirements for the M-35 Multifamily Residential District; and, Ordinance No. 2023-03, approving the Rezoning of Designated Parcels to Downtown Business District Area 13 and to M-35 Multifamily Residential consistent with the Housing Element of the Danville 2030 General Plan ORDINANCE NO. 2023-03 WAS REMOVED FOR A SEPARATE VOTE 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 7, 2023 6.6Consider adoption of Resolution No. 5-2023, authorizing the Contra Costa County Flood Control and Water Conservation District to adopt the Fiscal Year 2023/24 fee for the Town of Danville Stormwater Utility Area 6.7Consider adoption of Resolution No. 7-2023, accepting a Grant of Storm Drain Easement located at 232 Loch Lomond Way MOTION BY VICE MAYOR STEPPER, SECOND BY COUNCILMEMBER MORGAN, TO APPROVE THE CONSENT CALENDAR, WITH THE EXCEPTION OF ORDINANCE NO. 2023-03 MOTION CARRIED 5-0 6.5 Ordinance No. 2023-03, approving the Rezoning of Designated Parcels to Downtown Business District Area 13 and to M-35 Multifamily Residential consistent with the Housing Element of the Danville 2030 General Plan REMOVED FOR SEPARATE VOTE Councilmember Arnerich will abstain from voting on this item due to a conflict of interest on sites R1, R2 and S and the proximity of his personal residence to the sites. MOTION BY COUNCILMEMBER MORGAN, SECOND BY VICE MAYOR STEPPER, TO INCLUDE SITES R1, R2 AND S IN THE LIST OF SITES BEING REZONED TO DOWNTOWN BUSINESS DISTRICT AREA 13; MULTIFAMILY RESIDENTIAL HIGH DENSITY SPECIAL DISTRICT, APPROVED BY THE DANVILLE TOWN COUNCIL AT A SPECIAL MEETING ON JANUARY 17, 2023, BY THE FOLLOWING VOTE: MOTION CARRIED 4-0-1-0; COUNCILMEMBER ARNERICH ABSTAINED Mayor Storer will abstain from voting on this item due to a conflict of interest on site N and proximity of property he owns at 1011 Hartz Way to the site. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 7, 2023 MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER FONG, TO INCLUDE SITE N IN THE LIST OF SITES BEING REZONED TO DOWNTOWN BUSINESS DISTRICT AREA 13; MULTIFAMILY RESIDENTIAL HIGH DENSITY SPECIAL DISTRICT, APPROVED BY THE DANVILLE TOWN COUNCIL AT A SPECIAL MEETING ON JANUARY 17, 2023, BY THE FOLLOWING VOTE: MOTION CARRIED 4-0-1-0; COUNCILMEMBER STORER ABSTAINED 7.
