SUMMARY OF ACTIONS
January 17, 2023 - DRAFT
1. CALL TO ORDER
The special meeting of the Danville Town Council was called to order by Mayor
Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA.
Present: Robert Storer, Mayor
Karen Stepper, Vice Mayor
Newell Arnerich, Councilmember
Dave Fong, Councilmember
Renee Morgan, Councilmember
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance to the flag was led by Mayor Storer.
3. PUBLIC HEARINGS
5.1 CONSIDER INTRODUCTION OF ORDINANCE NOS. 2023-01, 2023-02,
AND 2023-03 AND ADOPTION OF RESOLUTION NO. 4-2023,
CERTIFYING A FINAL PROGRAMMATIC ENVIRONMENTAL IMPACT
REPORT, REPEALING THE 2013-2021 HOUSING ELEMENT OF THE
GENERAL PLAN, APPROVING THE TOWN’S 2023-2031 HOUSING
ELEMENT OF THE GENERAL PLAN GPA22-0001, APPROVING
GENERAL PLAN AMENDMENT LAND USE, TEXT AND MAP
AMENDMENTS GPA22-0002, ZONING TEXT AMENDMENT ZTA22-
0001, REZONING RZ22-001
Mayor Storer noted that two Councilmembers have conflicts of interest on
some of the potential sites that would be addressed during the meeting.
Assistant Town Manager Tai Williams and Chief of Planning David
Crompton presented the staff report.

Mayor Storer opened the item to Town Council for questions.
Ms. Williams, Mr. Crompton and Town Manager Joe Calabrigo answered
the Town Council’s questions.
Mr. Calabrigo explained the conflict of interest rules established by the Fair
Political Practices Commission that allow for a segmentation process. The
segmentation process was explained.
Councilmember Arnerich recused himself and departed the meeting room.
Mr. Calabrigo explained the conflict of interest with Councilmember
Arnerich and the Village Shopping Center, Town and Country Shopping
Center and the Wells Fargo Bank site at the corner of San Ramon Valley
Blvd. and Town and Country Drive.
Mayor Storer opened the public hearing for comments and or questions on
the Village Shopping Center, Town and Country Shopping Center and the
Wells Fargo Bank site at the corner of San Ramon Valley Blvd. and Town
and Country Drive only.
The following speakers addressed the Town Council:
Maggie McClaren asked if the state would consider the water shortage and
building new units.
Donna Bruner stated that she has been a tenant of the Village Shopping
Center for 20 years and expressed her concern that current tenants will be
put out of business due to this designation. She expressed concern that
many of the businesses will need to move out of Danville and she opposed
the designation.
David Nycer stated that he believes there are other more appropriate sites
for development, for example the Danville Bowl.
Mayor Storer closed the item for public comment.
Mr. Calabrigo and Mr. Crompton responded to questions from the public.

MODIFY RESOLUTION NO. 4-2023 TO INCLUDE SITES R1, R2, AND S IN THE
APPROVED HOUSING ELEMENT AND IN THE AMENDED LAND USE MAP IN
THE GENERAL PLAN FOR ORDINANCE NO. 2023-03, THE THREE SITES WILL BE
INCLUDED IN THE LIST OF PROPERTIES BEING REZONED
MOTION CARRIED 4-0-1-0; COUNCILMEMBER ARNERICH ABSTAINED
Councilmember Arnerich re-entered the meeting room at 6:14 p.m.
Mayor Storer recused himself and departed the meeting room. Vice Mayor
Stepper presided over the meeting.
Mr. Calabrigo reviewed the conflict of interest with Mayor Storer and site
N, the Crossroads Shopping Center, 480 and 486 San Ramon Valley Blvd.
Mr. Crompton responded to Town Council Questions.
Vice Mayor Stepper opened the public hearing for comments and questions
on site N only.
The following speaker addressed the Town Council:
Maggie McClaren asked if site N and the other sites will fulfill the units that
are needed to be built and asked about the building height.
Vice Mayor Stepper closed the public hearing.
Mr. Crompton answered the question raised from the public.
MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER FONG,
TO MODIFY RESOLUTION NO. 4-2023, TO INCLUDE SITE N IN THE APPROVED
HOUSING ELEMENT AND IN THE AMENDED LAND USE MAP IN THE GENERAL
PLAN; AND FOR ORDINANCE NO. 2023-3, THE SITE WILL BE INCLUDED IN THE
LIST OF PROPERTIES BEING REZONED
MOTION CARRIED 4-0-1-0; MAYOR STORER ABSTAINED
Mayor Storer re-entered the meeting at 6:21 p.m. and continued to preside
over the meeting.

Mayor Storer opened the item to questions from the Town Council that do
not involve the four sites previously discussed.
Ms. Williams and Mr. Crompton responded to questions from the Town
Council.
Mayor Storer opened the item for public comments on sites that have not
previously been discussed.
The Town received written correspondence from the following individuals
and was provided to the Town Council prior to the meeting:
Kevin Burke on behalf of East Bay for Everyone
Bob McCleary
Wendy Sula
The following speakers addressed the Town Council:
David Weiner expressed concern with the traffic problems that already
exist in Danville and asked if the state will come forward with funds to
improve transportation. He stated that he moved here for the quality of a
small Town and he would like to see that retained.
Ryan McNamera, Blake Griggs Properties, expressed support for the
housing element.
Jim Wood, one of the owners of 2900 Camino Tassajara, special concern
area, wanted to confirm that the Town Council had received the modified
wording that he had worked on with staff.
Joseph Gorny stated that he does not believe that modern design is the
Danville style and is concerned that developers will not be held to a high
level of design standards. He asked that the Town focus on stepping up the
Design Review process and getting high-level designs.
Name not stated, questioned the tax impact and penalties, and questioned
what would happen if the housing element were approved but the number
of homes needed are not built. He questioned how the Town will come up
with more housing for the next housing element.

TEXT FOR THE WOODRANCH SPECIAL CONCERN AREA AND THE ACTIONS
SEPARATELY APPROVED REGARDING SITES N, R1, R2 AND S AND CERTIFYING
A FINAL PROGRAMMATIC ENVIRONMENTAL IMPACT REPORT, REPEALING
THE 2013-2021 HOUSING ELEMENT OF THE GENERAL PLAN, APPROVING THE
TOWN’S 2023-2031 HOUSING ELEMENT OF THE GENERAL PLAN GPA22-0001,
APPROVING GENERAL PLAN AMENDMENT LAND USE, TEXT AND MAP
AMENDMENTS GPA22-0002, ZONING TEXT AMENDMENT ZTA22-0001,

Vice Mayor Stepper requested an amendment to the motion, requesting to eliminate
Mitigation Measure GHG-21, which would prohibit the use of natural gas in the new
residential development approved as part of the Housing Element. She stated the concern
that use of electrical power only would result in unreliable services due to ongoing Public
Safety Power Shutoffs (PSPS), loss of power in the winter during storms as the vast
majority of power lines in Danville are above ground, and that the loss of electrical power
would result in the loss of basic needs such as lights, heating, and cooling, which is
detrimental to public health and safety.
Councilmember Arnerich agreed to the requested revision to the motion.
MOTION CARRIED 5-0
Mr. Calabrigo explained that the City Clerk will annotate Resolution No. 4-2023
and Ordinance 2023-03 to reflect the separate votes on sites N, R1, R2, and S and
the three ordinances will return to the Town Council on February 7 for adoption.
