HomeMy WebLinkAbout020723 HOUSING ELEMENT-CONFLICTS OF INTEREST PROCESS "Small Toxon Atmosphere Outstanding Quality of Life" - jIA1�IVLLE This is a more compact version of handling the conflicts of interest related to Housing Element Implementation, specifically the second reading of the three implementing ordinances on consent calendar tonight. 1. At "Changes to the Order of the Agenda," Joe will announce that we will need to remove the second reading of Ordinance No. 2023-03 from consent calendar in order to address potential conflicts of interest. 2. When we get to Consent Calendar, any of the five councilmembers may move and second approval of the consent calendar, minus Ordinance No. 2023-03. 3. The Mayor (or Rob) will then announce that the Council will be taking three separate votes for Ordinance 2023-03 to address conflicts of interest. a. Rob will announce that Councilmember Arnerich has a conflict of interest because his residence is located within either 500 or 1000 feet of the following three sites on the list: R1 (the Wells Fargo Bank at the corner of San Ramon Valley Blvd and Town and Country Drive), R2 (the Town & Country Shopping Center) and S (the Village Shopping Center). b. The Mayor will ask if there is anyone in the audience wishing to address the rezoning of those 3 sites. c. If there is, then Councilmember Arnerich will need to leave the room to allow for the public comment. If not, he may stay at the dias. d. In either event, any of the remaining councilmembers may make the following motion: i. Approve second reading and adoption of Ordinance No. 2023-03 for sites R1, R2 and S. Rob will announce that Mayor Storer has a conflict of interest because he has an ownership interest in the apartment building at 1011 Hartz Way, which is within 500 of Site N (the Crossroads Shopping Center, 480 and 486 San Ramon Valley Blvd.) a. The Vice Mayor will ask if there is anyone in the audience wishing to address the rezoning of that site. b. If there is, the Mayor will leave the room to allow for public comment. If not, he may stay at the dias. c. In either event, any of the remaining councilmembers may make the following motion: i. Approve second reading and adoption of Ordinance No. 2023-03 for site N. Robert abstains. 5. The Mayor will then ask if there are any public comments on any of the other properties proposed for rezoning in the ordinance. 6. At that point, any member of the Council can move and second the following motion: a. Approve second reading and adoption of Ordinance No. 2023- 03 with the exception of the four sites already voted on.
