Each California community must accommodate its ‘fair share’ of projected housing needs for all income levels. Accomplished by: ▪Updating Housing Element every 8 years ▪This is the 6th Cycle (2023-2031) ▪Penalties for non-compliance Housing Element Process: Macro View State projects California’s housing needs every 8 years; assigns targets to all regions Regional agency develops methodology to distribute housing targets to cities and counties Cities/Counties must identify housing sites to accommodate assigned target Step 2 State-driven process, involving 3 levels of government. San Francisco Bay Region assigned 441,176 new units (2023-2031 cycle) Town of Danville assigned 2,241 new units from region (May 2021) Step 1 (June 2020) Step 3 (2022) RHNA Housing Assignments in Contra Costa County 5 Penalties for Non- Compliance Cumulative result of many enacted state legislation since 5th Cycle Cumulative result of many housing legislation enacted since the prior housing element (5th cycle): 1.Limited access to state funding,including transportation funding for local roadway maintenance and capital improvement projects 2.Court imposed fines of up to $600,000 per month. What does it include? ▪Housing Needs Assessment ▪Housing Constraints Analysis ▪Housing Resources ▪Housing Sites Inventory ▪Housing Element Review ▪Fair Housing Assessment ▪Implementation Plan Danville 2022-2031 Housing Allocation Net New Units to be Accommodated Excerpt from Planning Commission Staff Report, December 13, 2022, Page 5 Proposed Housing Opportunity Sites Proximate to Transportation Corridors and Access to Services State Department of Housing & Community Development (State HCD) Summary of Comments 1.Needs Assessment: Similar comments for most jurisdictions. Town Response: Revised document to include requested information and analysis. 2.Constraints Analysis: Further analysis requested for land use and development controls. Town Response: Revised document to address comments, including calculating density using gross acreage rather than net acreage. 3.Fair Housing Assessment: Similar comments for most jurisdictions, requesting deeper analysis and contributing factors. Town Response: Revised document to provide deeper analysis and prioritization of contributing factors. 4.Sites Inventory: Further site analysis and realistic capacity of ADUs requested. Town Response: Revised document to provide deeper analysis and explanation, including adjustment of sites inventory. 5.Implementation Plan: Further detail requested on timing and completion. Town Response: Revised programs to more explicitly comply with State requirements. Danville Planning Commission Hearing Summary of Comments 1.State Requirements and Development Standards: Concerned that Housing Element would not meet HCD criteria and Danville development standards too stringent. Town Response: Housing Element will include revisions that reflect HCD comments as well as public comments prior to final submittal. Proposed relaxation of development standard to permit density calculation based on gross (rather than net) acreage. 2.Density Increase: Property owner requested higher density on proposed housing site. Town Response: Recommends baseline density to remain at 30 du/ac. Invoked State Density Bonus provisions would allow density to typically increase 30% or more. 3.Property Value Increases: Question about how the Town proposes to utilize additional tax revenues that would be generated by more housing. Town Response: No excess revenues are expected given the level of municipal services and infrastructure needs generated by new housing. Fiscal analysis conducted in FY 2017/18 concluded that each residential unit: ▪Requires approximately $2,798 in municipal services (average annual) ▪Generates approximately $1,743 in revenues (average annual) or 63% of costs Residential units result in net revenue loss. Danville Planning Commission Hearing Summary of Comments (continued) 4.Open Space: Concerned that open space would be considered as housing sites. Town Response: While open space sites were suggested by the public and evaluated as a part of the process, there are no open space sites on the current housing inventory. 5.Services and Infrastructure: Concerned about the lack of services and infrastructure for new development (schools, water, roads, etc.). Town Response: Danville expressed similar concerns as part of: a.Appeal of its 2023-2031 RHNA housing assignment (filed July 9, 2021) -Danville’s appeal was denied by the Association of Bay Area Governments (ABAG) in January 2022. Letter available at DanvilleTownTalks.org Subsequent to Planning Commission hearing, property owner comments received regarding Wood Ranch Headquarters. Environmental Review Final Programmatic Environmental Impact Report (Final PEIR) Comments received focused on concerns related to: ▪Greenhouse Gas (GHG) Emissions ▪Vehicle Miles Traveled (VMT) ▪Water Service Recommendation: ▪Mitigation Measures ▪Statement of Overriding Considerations Implementing Actions General Plan & Zoning Amendments 1.General Plan Land Use & Text Amendments a.Add new multifamily land use designation (allows 30-35 du/ac) “Residential-Multifamily Special” b. SUMMARY OF THE MOTION Ordinance No. 2023-01: Zoning text amendment to add new Downtown Business District (DBD) Area 13, to allow for 30-35 du/ac on Housing Opportunity Sites within the downtown area. Ordinance No. 2023-02: Zoning text amendment to add new M-35; Multifamily Residential District with objective standards to allow for 30-35 du/ac on Housing Opportunity Sites outside of the downtown area. Ordinance No. 2023-03: Rezoning of lands identified as Housing Opportunity Sites to M-35 or DBD Area 13. Resolution No. 4-2023: Collection of actions that would: 1.Certify the Final Programmatic Environmental Impact Report 2.Approve an updated Danville 2023-2031 Housing Element, reflects changes in response to initial State HCD comments 3.Approve General Plan land use, text and map amendments (including revised Wood Ranch Special Concern Area language) Recommended Motion
