SUBJECT: Resolution No. 3-2023, confirming the Director of Emergency Services
proclamation of existence of a local emergency
BACKGROUND
On December 31, 2022, the Town experienced flooding and mudslides in several
neighborhoods as a result of the atmospheric river which hit the Bay Area. A number of
trees were also lost due to high winds and saturated soils. On January 3, 2023, the Town
Manager, acting in the role of Director of Emergency Services, proclaimed the existence of a
local emergency based on the initial storm and the impending second atmospheric river
which arrived on January 4. This proclamation of emergency has allowed the Town to
expend funds and enter into contracts with vendors necessary to address the problems
created by the storms.
DISCUSSION
Pursuant to Government Code Section 8630, the proclamation is valid for seven days. In
order to extend the local emergency, the Town Council must take action. Based on the
continued rain and wind affecting the Town, it is recommended tha t the Council adopt the
attached resolution confirming the original proclamation. (Exhibit 1)
PUBLIC CONTACT
This item is being added as an urgency item pursuant to Government Code Section
54954.2(b)(2).
FISCAL IMPACT
There is no immediate fiscal impact from adoption of the resolution. The Town is spending
necessary funds for emergency contractors to assist in clean up and prevention of further
damage that are beyond the resources of the Town or require specialized equ ipment that
the Town does not own or have access to. A final total cost of the storm response will be
developed once the event is completed.

existence of a local emergency.

RESOLUTION NO. 3-2023
CONFIRMING THE DIRECTOR OF
EMERGENCY SERVICES’ PROCLAMATION OF EXISTENCE OF A LOCAL
EMERGENCY
WHEREAS, Section 2-9.6.a.1 of the Danville Municipal Code empowers the Director of
Emergency Services to proclaim the existence or threatened existence of a local
emergency when the Town Council is not in session, which proclamation must be
confirmed by the Town Council within seven days; and
WHEREAS, on January 3, 2023, the Town’s Director of Emergency Services did proclaim
a local emergency within the Town of Danville (Exhibit 1), based on the following
conditions:
1. On December 31, 2022, the Town experienced flooding and mudslides due to a
high volume of rain from an “atmospheric river” as well as strong winds bringing
down trees. This storm has required the Town to retain contractors with
specialized equipment and supplies to assist in the clean up, which is still ongoing.
2. The National Weather Service had warned that a second atmospheric river would
arrive in the San Francisco Bay Area in the early hours of January 4, 2023, with the
potential for additional heavy rainfall hitting Danville for a pe riod in excess of 24
hours.
3. The storm of December 31 and the storm event of January 4 created the need for
emergency services beyond the capabilities or resources of the Town to handle by
itself; and
WHEREAS, the Town Council, having met within seven days of the original
proclamation, has determined that the conditions warranted the proclamation of a local
emergency and still exist, especially with additional rain and wind impacting the Town;
now, therefore, be it
RESOLVED, by the Danville Town Council that the Proclamation of Existence of a Local
Emergency, as issued by the Director of Emergency Services on January 3, 2023, is hereby
ratified and confirmed; and, be it further
RESOLVED, that Town staff shall take any actions necessary to seek reimbursement for
emergency expenses incurred should such disaster funding become available; and, be it
further
RESOLVED that the local emergency shall be deemed to continue to exist until its
termination is proclaimed by the Danville Town Council, which shall review the need to
continue the emergency as required by Government Code Section 8630(c)(1).
