ADMINISTRATIVE STAFF REPORT
TO: Mayor and Town Council January 10, 2023
SUBJECT:Resolution No. 2-2023, approving a Notice of Completion for the 500 La
Gonda Way Tenant Improvements Project, CIP No. B-626
BACKGROUND
The Town's Capital Improvement Program (CIP) includes Project No. B-626, relocating the
Danville Town Offices and Police Department to 500 La Gonda Way. The work was
completed in two phases. Phase I included constructing 18,878 square feet of tenant
improvements to house the Danville Police Department and related parking and landscape
site enhancements. Phase II included constructing 22,120 square feet of tenant
improvements to the ground floor of the office building that houses all other Town
departments.
DISCUSSION
The project is now complete and ready for acceptance by the Town. All work was performed
in accordance with the approved plans and specifications.
The original contract amount of $5,924,000 was increased by $4,304,835.35 as a result of 32
Contract Change Orders. The change orders included items such as additional elevator
structural steel, parking lot paving and landscape, removal and replacement of exterior
stone veneer, and the addition of all Phase II work.
The final contract amount of $10,288,835.35 (contract plus change orders) is within the
authorized construction budget for this project.

RESOLUTION NO. 2-2023
APPROVING A NOTICE OF COMPLETION FOR THE 500 LA GONDA WAY
TENANT IMPROVEMENTS PROJECT, CIP NO. B-626
on November 17, 2020, the Town of Danville awarded a construction
WHEREAS,
contract to D.L. Falk Construction, Inc. for the 500 La Gonda Way Tenant Improvements
Project, CIP No. B- 626; and
the City Engineer has determined that the work under this project has been
WHEREAS,
completed as of January 10, 2023, in accordance with the plans and specifications thereof;
and
California Civil Code section 9204 specifies the requirements for recordation
WHEREAS,
of a Notice of Completion; and
not less than thirty days (30) nor more than forty-five (45) days after a Notice
WHEREAS,
of Completion is recorded the Town must release all undisputed retention payments to
the contractor; now, therefore, be it
by the Danville Town Council that said work by and with D.L. Falk
RESOLVED,
Construction, Inc. is hereby accepted as complete; and, be it further
that the City Clerk is hereby authorized and directed to file with the
RESOLVED,
Country Recorder of the County of Contra Costa, a Notice of Completion for said project
within fifteen (15) days from the date hereof; and, be it further
that undisputed retention payments be released in accordance with
RESOLVED,
Sections 8812 and 9356 of the California Civil Code.

RESOLUTION NO. 77-2020
AWARDING A CONSTRUCTION CONTRACT FOR THE TOWN OFFICE
RELOCATION PROJECT, CIP NO. B-626
the Danville Town Council has appropriated funding in the Capital
WHEREAS,
Improvement Program for the Town Office Relocation Project, CIP No. B-626; and
the plans and specifications for the subject project have been designed by
WHEREAS,
William Wood Architects, the original designer of the buildings at 500 La Gonda Way;
and
the City Clerk of this Town did, in open session on the 5thday of
WHEREAS,
November, 2020, publicly open and read aloud the sealed bids received as required by
law; and
, the lowest responsive bidder is DL Falk Construction, Inc. of Hayward,
WHEREAS
California, and the City Engineer has recommended awarding a contract for the project
to said contractor; now, therefore, be it
by the Danville Town Council, that the Town award the construction
RESOLVED,
contract for the Town Office Relocation Project, CIP No. B-626 to DL Falk Construction,
Inc. of Hayward, California; and, be it further
by the Danville Town Council, that the Town Manager be and hereby is
RESOLVED,
authorized to execute, on behalf of the Town, a written contract with DL Falk
Construction, Inc. for $5,924,000 and authorize use of a 20% construction contingency of
$1,184,800 for a total construction budget of $7,108,800 for work in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto the
official seal of the Town; and, be it further
that staff shall within five (5) days of the adoption of this resolution,
RESOLVED,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards
of such findings.)
