SUBJECT: Resolution No. 100-2022, awarding a professional services agreement for
the El Pintado Drainage Improvements Design, CIP No. C-402
BACKGROUND
The Town’s Capital Improvement Program (CIP) includes the El Pintado Overlay – El
Cerro Blvd. to I-680, CIP Project C-402. The project consists of storm drainage
improvements and pavement rehabilitation.
The project in general will improve the existing drainage system and provide a new
paving surface on El Pintado Road starting from the east at El Cerro Boulevard to the
west end at El Rio Road.
DISCUSSION
In September 2022, a Request for Proposal (RFP) for engineering design services to
develop construction plans and specifications for drainage improvements was posted to
the Town’s website. In response, three (3) proposals were received from local consulting
firms. The Town carefully reviewed and ranked the three submitted proposals. Kimley-
Horn of Pleasanton, CA received the highest ranking and was found to be the most
qualified consultant for the project.

Posting of the meeting agenda serves as notice to the general public.
FISCAL IMPACT
The amount for the design contract is $110,795.00. An additional 15% design contingency
in the amount of $17,000 will be reserved for a total design budget of $127,795. Sufficient
funds to cover the design contract and contingency are contained in the El Pintado
Overlay – El Cerro Blvd to I-680, CIP No. C-402 (Attachment B).

AWARDING A PROFESSIONAL SERVICES AGREEMENT FOR THE
EL PINTADO IMPROVEMENTS DESIGN, CIP NO. C-402
WHEREAS, the Danville Town Council previously appropriated funding for the El
Pintado Overlay – El Cerro Blvd. to I-680, CIP No. C-402, in the adopted 2022/23 Capital
Improvement Program; and
WHEREAS, the Town circulated a Request for Proposal (RFP) to select the most qualified
and experienced consultant firm to provide storm drainage improvements design
services for the project; and
WHEREAS, the Town issued the RFP on September 26, 2022, and received three (3)
proposals by November 10, 2022, that were evaluated and scored; and
WHEREAS, Kimley-Horn of Pleasanton, CA was determined to be the most qualified
consultant; and,
WHEREAS, sufficient funds have been appropriated in the Capital Improvement
Program for CIP No. C-402, the El Pintado Overlay – El Cerro Blvd. to I-680; now,
therefore, be it
RESOLVED, by the Danville Town Council that the Town Manager be and hereby is
authorized to execute on behalf of the Town, the Professional Services Agreement with
Kimley-Horn of Pleasanton, CA with a not-to-exceed budget of $110,795, and that the
Town Manager be authorized to establish and utilize a 15% design contingency in the
amount of $17,000 for additional work that may be subsequently approved by contract
amendment.
