HomeMy WebLinkAbout110122-06.3 ADMINISTRATIVE STAFF REPORT 6.3 TO: Mayor and Town Council November 1, 2022 SUBJECT: Resolution No. 91-2022, amending the construction contract and authorizing the Town Manager to execute contracts for Phase II and Site Improvements for the Town Office Relocation Project, CIP No. B-626 BACKGROUND The Town is in the process of completing tenant and site improvements to the building located at 500 La Gonda Way (CIP Project B-626, the Town Office Relocation Project). Work is being completed in two phases. Phase I includes constructing 18,878 square feet of tenant improvements to house the Danville Police Department, along with related parking and landscape site improvements. Phase II includes constructing 22,120 square feet of tenant improvements to the ground floor of the office building that will house all other Town departments currently located at 510 La Gonda Way. The Town has previously awarded several contracts required to complete project construction. As the project nears completion, further Town Council authorization is required to complete all Phase I and Phase II work. Sufficient funds are available in CIP Project B-626 to complete the required additional work. DISCUSSION On November 17, 2020, the Town Council adopted Resolution No. 77-2020, awarding a Phase I construction contract to D.L. Falk Construction, Inc. for an amount not to exceed $7,108,800. On February 1, 2022, the Town Council adopted Resolution No. 6-2022 amending the contract with D.L. Falk to include Phase II improvements and parking lot construction for the Police Department. The contract amendment increased the contract amount with D.L. Falk by $1,886,002, to a total of $8,994,802. With Phase I tenant improvements for the Police Department now completed, focus has shifted to completing tenant improvements required for Phase II of the project and remaining site work. In order to complete the project, additional Town Council authorization is sought for the following: • Amending the construction contract with D.L. Falk to cover change order and additional Phases I and II work, and project closeout. This will increase the contract amount for D.L. Falk from $8,994,802 to $10,222,712. D.L Falk Contract Amendment 2 November 1, 2022 for CIP No. B-626 • Authorizing the Town Manager to execute contracts required to complete additional Phase II and site work including: re-carpeting and re-painting the Town Office space; installing site and building signage; re-paving the upper parking lot; providing emergency power; and relocating to the 500 La Gonda location. The total design and construction budget for the project is $14,691,691. Current contracted and actual expenses total $12,925,874, leaving a balance of $1,765,817. The following table describes additional expenses required to complete the work on Phases I and II, and the move into the new building. Remaining Balance $1,765,817 D.L. FISCAL IMPACT All funds required for the afore-mentioned contracts and expenses have been previously appropriated as part of CIP Project B-626 - Town Office Relocation Project. RECOMMENDATION Adopt Resolution No. 91-2022, amending the construction contract and authorizing the Town Manager to execute contracts for Phase II and Site Improvements for the Town Office Relocation Project, CIP No. B-626. B-626 WHEREAS, the Danville Town Council previously appropriated funding in the Capital Improvement Program for the Town Office Relocation Project, CIP No. B-626, and WHEREAS, the Town Council previously adopted Resolution No. 77-2020 and Resolution No. 6-2022 awarding a construction contract for Phases I and II of the Town Office Relocation Project to D.L. Falk Construction, Inc; and WHEREAS, change order and additional work for Phases I and II, and project closeout costs, have exceeded the previously approved total contract budget for D.L. Falk; and WHEREAS, the construction contract with D.L. Falk Construction, Inc. needs to be amended to increase the total authorized construction budget by $1,227,910 resulting in an amended total construction contract not to exceed $10,222,712; and WHEREAS, additional Phase II and site work beyond the scope of services provided by D.L. Falk are necessary to complete the project, including: $182,000 to re-carpet and re- paint the Town Offices, $80,000 to provide emergency back-up power to the Town Office data center; $77,500 to install building and site signage; $178,407 to re-pave and re-stripe the Town Office parking lot and $20,000 to relocate from 510 La Gonda Way to 500 La Gonda Way; and WHEREAS, sufficient funds have previously been appropriated by the Town Council in Town Office Relocation Project, CIP No. B-626 to fund the contract amendment and additional work required; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized to execute, on behalf of the Town, a contract amendment not to exceed $1,227,910 with D.L. Falk Construction, Inc. and additional contracts required to complete all other Phase I and Phase II work.
