SUMMARY OF ACTIONS
October 4, 2022
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Arnerich at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA.
Present: Newell Arnerich, Mayor
Robert Storer, Vice Mayor
Dave Fong, Councilmember
Renee Morgan, Councilmember
Karen Stepper, Councilmember
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance to the flag was led by high school student Travis Hodges.
3. CHANGES TO THE ORDER OF THE AGENDA
There were no changes.
4. FOR THE GOOD OF THE TOWN
Stewart Proctor expressed support for pickleball courts at Osage Station Park and
encouraged the Town, user groups and neighbors to work together.
The following individuals spoke in opposition to pickleball courts at Osage Station
Park:

Leeann Brown submitted a speaker card in opposition to pickleball courts at Osage
Station Park.
Mayor Arnerich stated that correspondence was submitted prior to the meeting
from MaryBeth Bykowsky, California Department of Insurance, on the program
titled "Safer from Wildfires in 1, 2, 3."
5. PROCLAMATIONS
5.1 Reading of a proclamation by Mayor Arnerich proclaiming October as
National Domestic Violence Awareness Month
Mayor Arnerich read the proclamation.
6. CONSENT CALENDAR
6.1 Consider approval of the Summary of Actions from the regular Town
Council meeting of September 20, 2022
6.2 Consider approval of the Register of Demands
6.3 Consider adoption of Resolution No. 86-2022, appropriating funds and
authorizing the Town Manager to execute a contract amendment for
consultant services for the preparation of a Programmatic Environmental
Impact Report related to the adoption of the 2023-2031 General Plan
Housing Element
6.4 Consider adoption of Resolution No. 87-2022, approving the amended date
and street closure limits for Flavors of Fall - A Celebration of Culture and
Community (formerly Danville Fallfest)

Joe Calabrigo provided the report.
8. COMMUNICATIONS
8.1 Quarterly Police Department Report by Danville Police Chief Allan Shields
Allan Shields provided the report and introduced new Police Department
personnel.
8.2 Development Services Department Report by Assistant Town Manager Tai
Williams
Tai Williams provided the report.
9. PUBLIC HEARINGS
9.1 Consider introduction of Ordinance No. 2022-05, amending the Town's
Downtown Business District Ordinance to allow a time extension for
expanded outdoor restaurant seating and establishing development
standards, design guidelines, a fee schedule related to the establishment of
parklets, allowing specific street closures and allowing the consumption of
alcohol within those street closures pursuant to Danville Municipal Code
Section 4-14.2b
Chief of Planning David Crompton presented the staff report.
Mr. Crompton and Deputy Town Manager Diane Friedmann responded to
questions from the Town Council.
Mayor Arnerich opened the item to public comment.

Mayor Arnerich closed the item to public comment.
The Town Council expressed support for the ordinance; directed staff to include
language that electrical can be included in parklets for lighting only and must meet
building code requirements; and strongly recommended that landscaping be
incorporated into parklets to soften the visual features of the protected areas.
MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER
STEPPER, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2022-05,
AMENDING THE TOWN'S DOWNTOWN BUSINESS DISTRICT ORDINANCE TO
ALLOW A TIME EXTENSION FOR EXPANDED OUTDOOR RESTAURANT SEATING
AND ESTABLISHING DEVELOPMENT STANDARDS, DESIGN GUIDELINES, A FEE
SCHEDULE RELATED TO THE ESTABLISHMENT OF PARKLETS, ALLOWING
SPECIFIC STREET CLOSURES AND ALLOWING THE CONSUMPTION OF
ALCOHOL WITHIN THOSE STREET CLOSURES PURSUANT TO DANVILLE
MUNICIPAL CODE SECTION 4-14.2b, AND RETURN FOR SECOND READING ON
OCTOBER 18, 2022, WITH THE FOLLOWING AMENDMENTS:
1. INCLUDE LANGUAGE THAT ELECTRICAL CAN BE INCLUDED IN
PARKLETS FOR LIGHTING ONLY AND MUST MEET BUILDING CODE
REQUIREMENTS; AND
2. STRONGLY RECOMMEND THAT LANDSCAPING BE INCORPORATED INTO
PARKLETS TO SOFTEN THE VISUAL FEATURES OF THE PROTECTED AREAS
