TO: Mayor and Town Council October 4, 2022
SUBJECT: Resolution No. 86-2022, appropriating funds and authorizing the Town
Manager to execute a contract amendment for consultant services for the
preparation of a Programmatic Environmental Impact Report related to
the adoption of the 2023-2031 General Plan Housing Element
BACKGROUND
As required by State Law, all cities and counties must maintain a General Plan Housing
Element which plans for the housing needs of its residents. The California Department of
Housing and Community Development distributes a Regional Housing Needs Allocation
(RHNA) to regional governments on an eight-year cycle. In turn, the regional
governments develop a methodology for the distribution of the housing units to
individual cities and counties, and local cities and counties must adopt a Housing
Element which accommodates the RHNA.
In order for the Town to meet its RHNA, a number of parcels throughout the Town will
need to be considered for General Plan land use designation amendments and associated
rezonings to provide for additional housing development sites. Potential environmental
impacts associated with any General Plan or zoning changes need to be studied within a
Programmatic Environmental Impact Report (PEIR).
DISCUSSION
The Town executed a contract with David J. Powers Associates, Inc. to perform the PEIR.
Subsequently, the scope of work was expanded to include the evaluation of additional
housing opportunity sites and updating the traffic analysis, requiring additional
modeling and documentation.
FISCAL IMPACTS
An additional appropriation of $82,000 to the existing David J. Powers Associates, Inc.
contract is necessary to fund these changes to the scope of work. All costs associated with
the adjusted scope of work would be funded by the Comprehensive Planning Fee Fund.

RECOMMENDATION
Adopt Resolution No. 86-2022, appropriating funds and authorizing the Town Manager
to execute a contract amendment for consultant services for the preparation of a
Programmatic Environment Impact Report related to the adoption of the 2023-2031
General Plan Housing Element.

RESOLUTION NO. 86-2022
APPROPRIATING FUNDS AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE A CONTRACT AMENDMENT FOR CONSULTANT SERVICES FOR
THE PREPARATION OF A PROGRAMMATIC ENVIRONMENTAL IMPACT
REPORT RELATED TO THE ADOPTION OF THE 2023-2031 GENERAL PLAN

WHEREAS, as required by State Law all cities and counties in California must maintain

WHEREAS, the California Department of Housing and Community Development

eight-year cycle. In turn, the regional governments develop a methodology for the

WHEREAS, local cities and counties must adopt a Housing Element which
accommodates the RHNA; and
WHEREAS, in order for the Town to meet its RHNA assignment, a number of parcels
throughout the Town will need to be considered for General Plan land use designation
amendments and associated rezonings to provide for additional housing development
sites; and
WHEREAS, potential environmental impacts associated with any General Plan or zoning
changes need to be studied within a Programmatic Environmental Impact Report (PEIR);
and
WHEREAS, the Town signed a contract with David J. Powers Associates, Inc. to perform
the PEIR; and
WHEREAS, the Town has identified additional work to be completed with the addition
of three housing opportunity sites and increased scope of work on the approach and
methodology for the project’s vehicle miles traveled (VMT) assessment, requiring
additional modeling and documentation; now, therefore, be it
RESOLVED, that the Danville Town Council appropriates $82,000 from the Town’s
Comprehensive Planning Fee Fund; and, be it further

RESOLVED, that the Danville Town Council authorize the Town Manager to execute a
contract amendment for consultant services for preparation of a PEIR related to the
adoption of the 2023-2031 General Plan Housing Element.
