Environmental Impact Report Public Comment Session

DESCRIPTION
This public hearing is provided as an opportunity for the public as well as the Planning
Commission to comment on the adequacy of the Draft Programmatic Environmental
Impact Report (DPEIR) which has been prepared for the planned implementation of the
Town’s 2023-2031 Housing Element (project). The merits of the project will not be
discussed, and no action will be taken on the draft EIR or the project at this meeting.
The DPEIR has been prepared to identify potential environmental impacts associated with
this the proposed implementation of the Town’s 2023-2031 Housing Element. The Housing
Element is a state-mandated policy document that is a component of the Town of Danville
2030 General Plan. The Housing Element contains policies and programs that support and
create the framework for the production, preservation, and maintenance of the Town’s
housing stock for all income levels.
As part of the Housing Element, the Town must comply with the State required Regional
Housing Needs Assessment (RHNA). As a result, the Town must plan for a minimum of
2,241 additional housing units at various affordability levels.
A number of parcels within the Town will need to receive a General Plan land Use
Amendment and Rezoning to create sufficient land capacity to accommodate the RHNA
requirement. This DPEIR studies the potential impacts related to the proposed General
Plan Amendment at a programmatic level.
DISCUSSION
In summary, the DPEIR found that for most areas of study, potential significant
environmental impacts can be mitigated to a less than significant level. However, the
DPEIR concluded that the Housing Element Update implementation will have
potentially significant and unavoidable environmental effects related to Greenhouse
Gas Emissions, Transportation, and Utilities and Service Systems. In addition, six of the
candidate housing sites are included on a list of hazardous materials sites compiled
pursuant to California Government Code Section 65962.5. Five of the listed sites are
shown as closed cases.
REVIEW PROCESS
The DPEIR is currently within the state-mandated minimum 45-day public review and
comment period, which started on September 13, 2022, and will end on October 28,
2022. A link to the DPEIR has been forwarded to all responsible or potentially
interested/concerned local and federal agencies. In addition, the DPEIR was sent to the
State Office of Planning and Research Clearinghouse for distribution to responsible
State agencies. This public hearing to allow for oral comments is not required, but is
encouraged under the California Environmental Quality Act (CEQA). Copies of the
DPEIR are available for review at the Danville Town Offices, Danville Public Library,
and on the Town’s web site: www.DanvilleTownTalks.org/HousingElement
Upon completion of the public review period, all written and verbal comments must be
responded to in writing in the Response to Comments document. The Response to
Comments document, in conjunction with the DPEIR, comprises the Final PEIR (FPEIR).
Once the FPEIR is complete, it will accompany the Town’s 2023-2031 Housing Element and
related General Plan Amendments and Rezoning though the public hearing process.
