SUBJECT: Resolution No. 76-2022, approving Quitclaim Grant Deed of Drainage
Easement located at 749 Glen Road
BACKGROUND AND DISCUSSION
On January 29, 1959, a grant deed to Contra Costa County for a non-exclusive drainage
easement, Book 3309, page 446, of Official Records, was recorded for the property located
at 749 Glen Road for drainage purposes (Attachment B).
The easement was intended to allow for an overland drainage ditch from the railroad right-
of-way. Improvements from the subsequent development of the adjacent subdivision SD
2606 made installation of the ditch unnecessary. There is no need for retention of the
easement.

RESOLUTION NO. 76-2022
QUITCLAIM GRANT DEED OF DRAINAGE EASEMENT
LOCATED AT 749 GLEN ROAD
WHEREAS, Mathew J and Alicia L Mathew are the owners of 749 Glen Road; and
WHEREAS, the Grant Deed (recorded in Book 3309 of maps page 446) granted to the
Town of Danville a 20’ drainage easement along the side lot of 749 Glen Road; and
WHEREAS, the Town wishes to quitclaim said grant deed; and
WHEREAS, said property lies within the corporate limits of the Town of Danville; now,
therefore, be it
RESOLVED, that the Danville Town Council hereby quitclaim the grant deed for
drainage purposes.
APPROVED by the Danville Town Council at a regular meeting on September 6, 2022,
by the following vote:
