HomeMy WebLinkAbout090622-06.07 ADMINISTRATIVE STAFF REPORT 6.7 TO: Mayor and Town Council September 6, 2022 SUBJECT: Resolution No. 76-2022, approving Quitclaim Grant Deed of Drainage Easement located at 749 Glen Road BACKGROUND AND DISCUSSION On January 29, 1959, a grant deed to Contra Costa County for a non-exclusive drainage easement, Book 3309, page 446, of Official Records, was recorded for the property located at 749 Glen Road for drainage purposes (Attachment B). The easement was intended to allow for an overland drainage ditch from the railroad right- of-way. Improvements from the subsequent development of the adjacent subdivision SD 2606 made installation of the ditch unnecessary. There is no need for retention of the easement. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. Williams Assistant Town Manager Attachments: A - Resolution No. 76-2022 B - Grant Deed for Drainage Purposes C - Quitclaim Deed Recorded at request of: Town of Danville When recorded, mail to: Town of Danville City Clerk 510 La Gonda Way Danville, CA 94526-1740 For Recorder’s Use RESOLUTION NO. 76-2022 QUITCLAIM GRANT DEED OF DRAINAGE EASEMENT LOCATED AT 749 GLEN ROAD WHEREAS, Mathew J and Alicia L Mathew are the owners of 749 Glen Road; and WHEREAS, the Grant Deed (recorded in Book 3309 of maps page 446) granted to the Town of Danville a 20’ drainage easement along the side lot of 749 Glen Road; and WHEREAS, the Town wishes to quitclaim said grant deed; and WHEREAS, said property lies within the corporate limits of the Town of Danville; now, therefore, be it RESOLVED, that the Danville Town Council hereby quitclaim the grant deed for drainage purposes.
