HomeMy WebLinkAbout090622-06.09 ADMINISTRATIVE STAFF REPORT 6.9 TO: Mayor and Town Council September 6, 2022 SUBJECT: Resolution No. 78-2022, appropriating funds and authorizing execution of a contract for third-party review of the Stormwater Management Plan for the Condominium Project located at 3020 Fostoria Way (DEV22-0009) BACKGROUND Trumark Homes has submitted preliminary Stormwater Management Plans as part of their submittal of a Development Plan application (DEV22-0009) which would allow for the development of a 165-unit multifamily townhouse project on a seven-acre site located at 3020 Fostoria Way, commonly known as the Borel property. DISCUSSION The applicant is required to have a third-party engineering service review the Stormwater Management Plan. The Town will manage the consultant expenses associated with the work which will be borne by the project applicant. The applicant will submit funds to the Town equivalent to the cost of the consultant’s contract, and the Town will disburse funds consistent with the terms of the contract. The Town selected Harrison Engineering, Inc. of Concord, California, as the third-party consultant for the project. The contract amount of $5,000, with an additional 20% contingency in the amount of $1,000 to be reserved for a total third-party review, results in a budget of $6,000. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. All costs associated with the third-party review will be borne by the applicant, Trumark Homes. Appropriation of funds to pay for the review will not result in a fiscal impact to the Town. Williams Assistant Town Manager Attachment: Resolution No. 78-2022 RESOLUTION NO. 78-2022 APPROPRIATING FUNDS AND AUTHORIZING EXECUTION OF A CONTRACT FOR THIRD-PARTY REVIEW OF THE STORMWATER MANAGEMENT PLAN FOR THE CONDOMINIUM PROJECT LOCATED AT 3020 FOSTORIA WAY (DEV22-0009) WHEREAS, the Town of Danville has received and is reviewing an application for a 165- unit multifamily townhouse development (DEV21-0009) , located at 3020 Fostoria Way, commonly known as the Borel property; and WHEREAS, the services of a third-party consultant are needed for the Town to plan check the Stormwater Management Plan for the development; and WHEREAS, the applicant is required to pay plan check fees for the Stormwater Management Plan; and WHEREAS, after soliciting a proposal for professional third-party review services for the Stormwater Management Plan, the Town desires to enter into a contract for plan review services with Harrison Engineering, Inc.; now, therefore, be it RESOLVED, that the Danville Town Council authorizes the Town Manager to execute an agreement with Harrison Engineering, Inc. of Concord, California for third-party plan review services; and be it further RESOLVED, that the contract amount of $5,000 with an additional 20% contingency in the amount of $1,000 for a total amount of $6,000 is appropriated for the review of the Stormwater Control Management Plan and Drainage Study.
