TO: Mayor and Town Council August 23, 2022
SUBJECT:Resolution No. 72-2022, providing for the appointment of the only two
nominees, Karen Stepper and Robert Storer, to the Danville Town Council
and requesting that the Contra Costa County Elections Division cancel the
General Municipal Election for the Danville Town Council to be held on
November 8, 2022
BACKGROUND
The Danville Town Council adopted Resolution No. 47-2022 requesting the Contra Costa
County Clerk Elections Department administer Danville's Consolidated Election on
November 8, 2022.
DISCUSSION
The deadline for filing nomination papers for the November 8, 2022 Municipal Election
was Friday, August 12. Incumbents Karen Stepper and Robert Storer were the only two
candidates who filed nomination papers for two seats on the Town Council.
As of the close of the nomination period, the number of persons who have been nominated
for those offices does not exceed the number to be filled at that election, the City elections
official shall submit a certificate of these facts (Attachment B) to the governing body of the
city and inform the governing body that it may, at a regular or special meeting held before
the municipal election, adopt one of the following courses of action:
1)Appoint to the office the person who has been nominated;
2)Appoint to the office any eligible elector if no one has been nominated;
3)Hold the election, if either no one, or only one person has been nominated.
Option 2 above is not applicable as Karen Stepper and Robert Storer have been nominated
and qualified. Because there are two nominees for the twoTown Council seats, the Town
Council may select either option No. 1 or option No. 3. It is common for cities tocancel
elections when there are not more candidates than offices to be elected.
Notice of these facts was published on August 17, 2022, in the San Ramon Valley Times
pursuant to Section 6061 of the Government Code. After the fifth day following the dateof
publication, the Town Council can meet to either make the appointments or direct an
election to be held. The persons appointed, shall qualify and take office and serve exactly
as if elected at a municipal election for the office.

Posting of the meeting agenda serves as notice to the general public.
FISCAL IMPACT
The Contra Costa County Election Divisionestimated that the November 8, 2022 municipal
election would cost the Town approximately $64,000 to $96,000 ($2-$3 per registered voter).
Cancellationof the Election would result in a direct savings to the Town.
RECOMMENDATION
Adopt Resolution No.72-2022, providing for the appointment of the only two nominees,
Karen Stepper and Robert Storer, to the Danville Town Council and requesting that the
Contra Costa County Elections Division cancel the General Municipal Election for the
Danville Town Council to be held on November 8, 2022.

PROVIDING FOR THE APPOINTMENT OF THE ONLY TWO NOMINEES,
KAREN STEPPER AND ROBERT STORER, TO THE DANVILLE TOWN COUNCIL
AND REQUESTING THAT THE CONTRA COSTA COUNTY ELECTIONS DIVISION CANCEL
THE GENERAL MUNICIPAL ELECTION FOR THE
DANVILLE TOWN COUNCIL TO BE HELD ON NOVEMBER 8, 2022
, the Town Council requested that the Contra Costa County Elections Office administer the
WHEREAS
Municipal Election to be held on Tuesday, November 8, 2022 to fill certain municipal offices; and
, pursuant to Elections Code Section 10229, as of the close of the nomination period on
WHEREAS
August 12, 2022, there are not more candidates than offices to be elected; and
Election Code Section 10229 allows one of the following courses of action to be taken by the

Town Council:
1.Appoint to the office the person who has been nominated;
