PROSPECT AVENUE AS A DANVILLE HERITAGE RESOURCE AND GRANTING A HERITAGE RESOURCE INCENTIVE PACKAGE WHEREAS, SONG C YUN is the owner of the property located at 178 E. Prospect Avenue (APN: 208-010-024); and WHEREAS, the property owner is requesting that the historic structure located at 178 E. Prospect Avenue be designated as a Heritage Resource; and WHEREAS, the property owner is requesting approval of a Heritage Resource Incentive Package; and WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires that the Heritage Resource Commission review and recommend Heritage Resource Incentive Package and Heritage Resource designation for Town Council approval; and WHEREAS, on June 13, 2022, the Town's Heritage Resource Commission adopted Heritage Resource Resolution No. 2022-01 recommending that the Town Council approve the request; and WHEREAS, the history of 178 E. Prospect Avenue includes the following: 1. The building was originally built prior to 1922. 2. The building was originally located at the corner of Prospect Avenue and Hartz Avenue, where the Veterans Memorial Building is currently located. 3. The building was owned by Mr. Bispo, followed by Bob Monroe, James Frederickson, Nan Rand and Jim Roos, and Ed Godoshian, respectively. 4. The building is representative of a particular architectural style and/or reflects special elements of a distinct historical period, type, style, or way of life important to the Town. RESOLVED, that the Danville Town Council designates 178 E. Prospect Avenue as a Heritage Resource and grants a Heritage Resource Incentive Package that includes the following: 1. Commitment by the Town to assist the developer in any efforts they undertake to obtain Federal and/ or State historic preservation grants and/ or aid; DocuSign Envelope ID: 7EC55187-6D11-47B7-B6A0-F41974672453 2. Upon the Town Council's approval of 178 E. Prospect Avenue as a Town Designated Heritage Resource, authorizes the Town Manager, on behalf of the Town, to enter into and execute a Mills Act Contract with the property owner, potentially providing for a reduction in property taxes associated with the historic building; 3. Authorizes application of the provisions of the Historic Building Code to work involving the historic building; 4. Upon the Town Council's approval of 178 E. Prospect Avenue as a Town Designated Heritage Resource, provides a Heritage Resource identification plaque for the building; 5. Waive all Town off-site parking in -lieu fees associated with the creation of additional off-site parking demand related to the property owner's planned conversion of the ground floor area from retail use to restaurant use. This fee is estimated to be $38,500; 7. Waives all other Town -controlled fees (except plan check fees where outside plan check consultant review services are utilized) associated with the issuance of building permits for interior tenant improvements related to conversion of the space to restaurant use; and 8. Inclusion of 178 E. Prospect Avenue in all marketing plans and public information brochures developed and maintained by the Town of Danville to increase public awareness of the Town's Historic Preservation Program.
