SUBJECT: Resolution No. 68-2022, designating 178 E. Prospect Avenue as a Danville
Heritage Resource and granting a Heritage Resource Incentive Package
BACKGROUND
On June 13, 2022, the Danville Planning Commission and Heritage Resource Commission
recommended the Town Council designate 178 E. Prospect Avenue as a Town-designated
Heritage Resource and grant a Heritage Resource Incentive Package.
DISCUSSION
Historic Significance
The Town’s Historic Preservation Ordinance states that a structure may be considered for
designation as a heritage resource if it has maintained its historic integrity, is over 50 years
of age, and meets at least one additional criterion. This criteria includes, but is not limited
to, being representative of a particular architectural style or reflects special elements of a
distinct historical period, type, style, or way of life important to the Town, and being the
site of an historical event or is associated with persons or events that have made a
meaningful contribution to the community, region, state, or nation.
The Heritage Resource Commission has determined the following criteria to qualify as
historically significant:
1.The building was originally built prior to 1922.
2.The building was originally located at the corner of Prospect Avenue and Hartz
Avenue, where the Veterans Memorial Building is currently located.
3.The building was owned by Mr. Bispo, followed by Bob Monroe, James Frederickson,
Nan Rand and Jim Roos, and Ed Godoshian, respectively.

4.The building is representative of a particular architectural style and/or reflects
special elements of a distinct historical period, type, style, or way of life important to
the Town.
Historic Preservation Incentive Package
The Town’s Historic Preservation Ordinance states that, “in order to more effectively and
equitably achieve the purposes of this section, the Town may offer incentives to the
owners of heritage resources and contributing properties in a historic district in order to
support the preservation, maintenance and appropriate restoration of those resources.
Preservation incentives shall be considered on a case-by-case basis and may include
economic assistance, and relaxation of otherwise applicable development standards or use
restrictions. The Heritage Resource Commission shall adopt by resolution a list of
potential preservation incentives.” A recommended list of historic preservation incentives
is contained within Town Council Resolution No. 68-2022 (Attachment). The key
components are comparable to the incentive packages approved for other historic
properties.
As part of the Historic Preservation Incentive Package, the recommended incentives for
this project include:
1.Commitment by the Town to assist the developer in any efforts they undertake to
obtain Federal and/or State historic preservation grants and/or aid;
2.Upon the Town Council’s approval of 178 E. Prospect Avenue as a Town
Designated Heritage Resource, authorizes the Town Manager, on behalf of the
Town, to enter into and execute a Mills Act Contract with the property owner,
potentially providing for a reduction in property taxes associated with the historic
building;
3.Authorizes application of the provisions of the Historic Building Code to work
involving the historic building;
4.Upon the Town Council’s approval of 178 E. Prospect Avenue as a Town
Designated Heritage Resource, provides a Heritage Resource identification plaque
for the building;
5. Waive all Town off-site parking in-lieu fees associated with the creation of
additional off-site parking demand related to the property owner’s planned
conversion of the ground floor area from retail use to restaurant use;

6.Waives all other Town-controlled fees (except plan check fees where outside plan
check consultant review services are utilized) associated with the issuance of
building permits for interior tenant improvements related to conversion of the
space to restaurant use; and
7.Inclusion of 178 E. Prospect Avenue in all marketing plans and public information
brochures developed and maintained by the Town of Danville to increase public
awareness of the Town’s Historic Preservation Program.

RECOMMENDATION
Adopt Resolution No. 68-2022, designating 178 E. Prospect Avenue as a Danville Heritage

DESIGNATING 178 E. PROSPECT AVENUE
AS A DANVILLE HERITAGE RESOURCE AND GRANTING
A HERITAGE RESOURCE INCENTIVE PACKAGE
WHEREAS, SONG C YUN is the owner of the property located at 178 E. Prospect Avenue
(APN: 208-010-024); and
WHEREAS, the property owner is requesting that the historic structure located at 178 E.
Prospect Avenue be designated as a Heritage Resource; and
WHEREAS, the property owner is requesting approval of a Heritage Resource Incentive
Package; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation)
requires that the Heritage Resource Commission review and recommend Heritage
Resource Incentive Package and Heritage Resource designation for Town Council
approval; and
WHEREAS, on June 13, 2022, the Town’s Heritage Resource Commission adopted
Heritage Resource Resolution No. 2022-01 recommending that the Town Council approve
the request; and
WHEREAS, the history of 178 E. Prospect Avenue includes the following:
1.The building was originally built prior to 1922.
