SUBJECT: Resolution No. 67-2022, approving a Notice of Completion for the 2020/21
Pavement Resurfacing Project, CIP No. C- 610E
BACKGROUND
The 2020/21 Pavement Resurfacing Project, CIP No. C-610E, is now complete. The project
consisted of applying Asphalt-Rubber Aggregate Membrane (ARAM) and Slurry Seal
treatment to various streets throughout the Town. ARAM and Slurry Seal is a cost-effective
preventative maintenance technique designed to extend the life of the existing pavement by
filling surface cracks and voids, providing a weather-tight seal, and adding texture and
uniform appearance to the street.
DISCUSSION
On December 21, 2021, the Town Council adopted Resolution No. 82-2021, awarding a
construction contract to American Pavement Systems, Inc. for the project in the amount of
$1,476,310 plus a 20% contingency of $295,262 for a total construction budget of $1,771,572.
During construction, three change orders were authorized including a pedestrian curb ramp
modification at the Wood Ranch Subdivision, extended curbside drain, and removal and
replacement of additional concrete valley gutter. As a result of these change orders, the
original contract amount of $1,476,310 was increased by $285,116.60, resulting in a total
construction cost of $1,761,426.60.

FISCAL IMPACT
The final contract amount of $1,761,426.60 is within the authorized construction budget for
this project.

RESOLUTION NO. 67-2022
APPROVING A NOTICE OF COMPLETION FOR THE 2020/21
PAVEMENT RESURFACING PROJECT, CIP NO. C- 610E
WHEREAS, on December 21, 2021, the Town of Danville awarded a construction contract
to American Pavement Systems, Inc., for the 2020/21 Pavement Resurfacing Project, CIP
No. C- 610E; and
WHEREAS, the City Engineer has determined that the work under this project has been
completed as of May 4, 2022, in accordance with the plans and specifications thereof; and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice
of Completion is recorded the Town must release all undisputed retention payments to
the contractor; now, therefore, be it
RESOLVED, by the Danville Town Council that said work by and with American
Pavement Systems, Inc., is hereby accepted as complete; and, be it further
RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Contra Costa, a Notice of Completion for said project within
fifteen (15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.
