SUBJECT: Resolution No. 63-2022, accepting SB 1383 Local Assistance Grant Program
funding and appropriating $62,906 to support SB 1383 compliance activities
through the Town and the RecycleSmart Joint Powers Authority
BACKGROUND
SB 1383, California’s Short-Lived Climate Pollutants Reduction Strategy, establishes targets
to reduce the statewide disposal of organics by 50% by 2020 and 75% by 2025; and requires
that no less than 20% of edible food that is currently disposed be recovered for human
consumption by 2025. Under SB 1383 each jurisdiction must develop methods for: managing
organics; procuring recycled organics; recovering edible food; regulating haulers; planning
for adequate edible food and organics waste processing capacity; and, conducting
education/outreach, inspections and enforcement.
In January 2022, CalRecycle announced a one-time Local Assistance Grant Program to aid
jurisdictions in the implementation of the SB 1383 regulations. The grant term is from April
2022 through December 2024. Through this program, the Town of Danville applied for and
has been awarded $62,906 in funding, based upon a per capita allocation.
DISCUSSION
The Town is a member of the RecyleSmart Joint Powers Authority, which provides solid
waste and recycling services to all of its member agencies. Under the SB 1383 Regulations,
the Town may designate a public or private entity to fulfill certain jurisdiction
responsibilities required under the SB 1383 regulations.
The Town proposes to allocate 85%, or $53,469, of the SB 1383 Local Assistance Grant
Program funds to RecycleSmart. These funds will be used to support RecycleSmart
Ordinance 21-1 compliance activities on the Town’s behalf including, but not limited to,
compliance audits, education and outreach, organics waste collection services, reporting
and record keeping, edible food recovery programs, and assistance with capacity planning.
The Town will retain 15% of the grant total, or $9,437, to cover paper procurement costs and
administrative costs to compile and submit annual reporting associated with these
purchases.

ACCEPTING SB 1383 LOCAL ASSISTANCE GRANT PROGRAM FUNDING
AND APPROPRIATING $62,906 TO SUPPORT SB 1383 COMPLIANCE
ACTIVITIES THROUGH THE TOWN AND THE RECYCLESMART
JOINT POWERS AUTHORITY

WHEREAS, the Town of Danville applied for and has been awarded $62,906 in funding,
based upon a per capita allocation; and
WHEREAS, under the SB 1383 regulations, the Town may designate a public or private
entity to fulfill certain jurisdiction responsibilities under the SB 1383 regulations; and
WHEREAS, the Town is a member of the Contra Costa Solid Waste Authority
(RecycleSmart) Joint Powers Authority, which provides solid waste and recycling
services to all of its member agencies; and
WHEREAS, the RecycleSmart Board of Directors adopted Ordinance 21-1 for the purpose
of implementing most of the SB 1383 regulations on behalf of Contra Costa Solid Waste
Authority members; now, therefore, be it
RESOLVED, that the Danville Town Council hereby accepts $62,906 of CalRecycle SB
1383 Local Assistance Grant Program funds and appropriates those funds to support SB
1383 compliance efforts; and, be it further
RESOLVED, that the Danville Town Council hereby transfers $53,469 of CalRecycle SB
1383 Local Assistance Grant Program funds to RecycleSmart to perform SB 1383
compliance activities on behalf of the Town of Danville.
