Prospect Avenue as a Town-designated Heritage Resource and granting a Historic Preservation Incentive Package. DESCRIPTION This public hearing is for the consideration of designating 178 E. Prospect Avenue as a Town-designated Heritage Resource and granting a Historic Preservation Incentive Package. EVALUATION Historic Significance The Town Historic Preservation Ordinance states that a structure may be considered for designation as a heritage resource if it has maintained its historic integrity, is over 50 years of age, and meets at least one additional criterion. This criteria includes, but is not limited to, being representative of a particular architectural style or reflects special elements of a distinct historical period, type, style, or way of life important to the Town, and being the site of an historical event or is associated with persons or events that have made a meaningful contribution to the community, region, state, or nation. 1. The building was originally built prior to 1922. 2. The building was originally located at the corner of Prospect Ave and Hartz Ave, where the Veteran’s Hall is currently located. 3. The building was owned by Mr. Bispo, followed by Bob Monroe, James Fredrickson, Nan Rand and Jim Roos, and Ed Godoshian respectively. 4. The building is representative of a particular architectural style and/or reflects special elements of a distinct historical period, type, style, or way of life important to the Town. 178 E Prospect Ave 2 June 13, 2022 Historic Preservation Incentive Package The Town Historic Preservation Ordinance states that, “in order to more effectively and equitably achieve the purposes of this section, the Town may offer incentives to the owners of heritage resources and contributing properties in a historic district in order to support the preservation, maintenance and appropriate restoration of those resources. Preservation incentives shall be considered on a case-by-case basis and may include economic assistance, and relaxation of otherwise applicable development standards or use restrictions. The Heritage Resource Commission shall adopt by resolution a list of potential preservation incentives.” A recommended list of historic preservation incentives is contained within Heritage Resource Commission Resolution No. 2022-01 (see Attachment). The key components are comparable to the incentive packages approved for other historic properties. As part of the Historic Preservation Incentive Package, the recommended incentives for this project include waiving all Town off-site parking in-lieu fees associated with the creation of additional off-site parking demand related to the property owner’s planned conversion of the ground floor area from retail use to restaurant use. Incentives also contain the inclusion of 178 E. Prospect Avenue in all marketing plans and public information brochures developed by the Town to increase public awareness of the Historic Preservation programs and a Designated Heritage Resource plaque to be placed on the building. RECOMMENDATION Adopt Resolution No. 2022-01, designating 178 E Prospect Ave as a Town-designated Heritage Resource and granting a Historic Preservation Incentive Package. Prepared by: Riley Anderson-Barrett Project Planner Attachment: Resolution No. 2022-01 RESOLUTION NO. 2022-01 RECOMMENDING THE TOWN COUNCIL DESIGNATE 178 E. PROSPECT AVENUE AS A TOWN-DESIGNATED HERITAGE RESOURCE AND GRANT A HISTORIC PRESERVATION INCENTIVE PACKAGE (APN: 208-010-024) WHEREAS SONG C YUN is the owner of the subject property located at 178 E Prospect Avenue; and WHEREAS, the property owner is requesting that the historic structure located at 178 E. Prospect Avenue be designated as a Heritage Resource; and WHEREAS, the property owner is requesting approval of a Historic Preservation Incentive Package; and WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires the Heritage Resource Commission review and recommend a Historic Preservation Incentive Package and Heritage Resource designation for Town Council approval; and WHEREAS, the history of 178 E. Prospect Avenue includes the following: 1. The building was originally built prior to 1922. 2. The building was originally located at the corner of Prospect Ave and Hartz Avenue, where the Veteran’s Hall is currently located. 3. The building was owned by Mr. Bispo, followed by Bob Monroe, James Fredrickson, Nan Rand and Jim Roos, and Ed Godoshian respectively. 4. The building is representative of a particular architectural style and/or reflects special elements of a distinct historical period, type, style or way of life important to the Town. RESOLVED that the Heritage Resource Commission recommends that the Danville Town Council designate 178 E. Prospect Avenue as a Heritage Resource and grant a Historic Preservation Incentive Package that includes the following: 1. Commitment by the Town to assist the developer in any efforts they undertake to obtain Federal and/or State historic preservation grants and/or aid; PAGE 2 OF RESOLUTION NO. 2022-01 2. Upon the Town Council’s approval of 178 E. Prospect Avenue as a Town Designated Heritage Resource, authorizes the Town Manager, on behalf of the Town, to enter into and execute a Mills Act Contract with the property owner, potentially providing for a reduction in property taxes associated with the historic building; 3. Authorizes application of the provisions of the Historic Building Code to work involving the historic building; 4. Upon the Town Council’s approval of 178 E. Prospect Avenue as a Town Designated Heritage Resource, provides a Heritage Resource identification plaque for the building; 5. Waive all Town off-site parking in-lieu fees associated with the creation of additional off-site parking demand related to the property owner’s planned conversion of the ground floor area from retail use to restaurant use. 6. Waives all other Town-controlled fees (except plan check fees where outside plan check consultant review services are utilized) associated with the issuance of building permits for interior tenant improvements related to conversion of the space to restaurant use; and 7. Inclusion of 178 E. Prospect Avenue in all marketing plans and public information brochures developed and maintained by the Town of Danville to increase public awareness of the Town’s Historic Preservation Program.
