HomeMy WebLinkAbout023-2022TOWN OF DANVILLE RECEIVED MAY 2 2022 Town Manager's Office Recorded at req0kILLE, CALIFORNIA Town of Danville When recorded, mail to: Town of Danville City Clerk 510 La Gonda Way Danville, CA 94526-1740 III II SII IIII 11 I111fl II III *$ R 0 0 0 0 7 1 5 2 3 8$* CONTRA COSTA Co Recorder Office DEBORAH COOPER, Clerk -Recorder DOC - 2022-0069626 Thursday, Apr21, 2022 15:37 Total Paid: No Fee Receipt#: 202200055843 0000•Public 190ISSPCI RESOLUTION NO. 23-2022 APPROVING THE REMOVAL OF DEFERRED IMPROVEMENT AGREEMENT DP 3003-82 FOR ASSESSOR'S PARCEL NUMBER 199-350-038 (321 HARTZ AVENUE) WHEREAS, the Town of Danville approved Development Plan DP 3003-82, allowing for development of the property located at 321 Hartz Avenue; and WHEREAS, associated with that approval, the Town adopted Resolution No. 75-83, approving Deferred Improvement Agreement DP 3003-82, which allowed the property owner to defer construction of certain public infrastructure on Hartz Avenue; and WHEREAS, the Deferred Improvement Agreement was recorded with the Contra Costa County Recorder on March 11, 1985, at Book 12219, Page 255; and WHEREAS, the City Engineer has determined that the improvements guaranteed by the Deferred Improvement Agreement have been constructed by the Town, meaning the terms of the Deferred Improvement Agreement have been satisfied; and WHEREAS, a potential buyer at 321 Hartz Avenue has requested that the Town remove the Deferred Improvement Agreement, thereby clearing the title to the property; now, therefore, be it RESOLVED, that the Danville Town Council approves the removal of Deferred Improvement Agreement DP 3003-82 for Assessor's Parcel Number 199-350-038 (321 Hartz Avenue); and, be it further RESOLVED, that Town staff is directed to record a copy of this resolution with the Contra Costa County Recorder.
