Danville Town Council, Planning Commission and Design Review Board – Special Study Session and Special Planning Commission Meeting Summary of Actions March 22, 2022 - DRAFT 1. CALL TO ORDER The special study session of the Danville Town Council, Planning Commission and Design Review Board was called to order by Mayor Arnerich at 4:00 p.m. The meeting was conducted by teleconference only. 1.1 Roll Call Administrative Assistant Kristine Meidberg conducted the roll call for attendance: Present: Councilmember Fong Councilmember Morgan Councilmember Stepper Vice Mayor Storer Mayor Arnerich Archie Bowles, Commissioner Robert Combs, Commissioner Mark Graham, Commissioner Mary Grace Houlihan, Commissioner Lou Palandrani, Commissioner Paul Radich, Vice Chair Chris Trujillo, Chair Mark Belotz, Board Member Kevin Wong, Board Member Afshan Hamid, Vice Chair Excused: None Danville Planning Commission – Special Meeting Summary of Actions - Draft March 22, 2022 2 It is noted that Chair Trujillo arrived at the meeting at 4:48 p.m. 1.2 Announcements Mayor Arnerich provided information regarding the format of the meeting and instructions for public comment. 2. “FOR THE GOOD OF THE TOWN” – To address the Town Council, Planning Commission and Design Review Board about a subject which is not listed on the agenda, click on the "Raise Your Hand" option in Zoom. Your name will be announced, and you will have up to three (3) minutes to share your comments. Rob Culin, Danville resident, urged the Town to provide more focus on sustainability and the impact we have on the environment. Mayor Arnerich closed the item for public comment. 3. STUDY SESSION 3.1 Town Council Updates Town Council Updates were given by Town Manager, Joseph Calabrigo. 3.2 Commission Updates Design Review Board Chair Palandrani gave an update on the Design Review Board. David Crompton, Chief of Planning gave an update on the Planning Commission. 3.3 Questions and Answers Questions from the Town Council, Planning Commission and Design Review Board were answered. 4. ADJOURN Mayor Arnerich adjourned the joint study session at 4:45 p.m. 5. CALL TO ORDER THE PLANNING COMMISSION MEETING Danville Planning Commission – Special Meeting Summary of Actions - Draft March 22, 2022 3 5.1 Roll Call All Commissioners were present. 6. ITEMS FOR CONSIDERATION/ACTION 6.1 Consider approval of the Summary of Actions from the March 8, 2022, Planning Commission special meeting. MOTION BY COMMISSIONER GRAHAM, SECOND BY COMMISSIONER HOULIHAN TO APPROVE THE SUMMARY OF ACTIONS FROM THE MARCH 8, 2022, PLANNING COMMISSION SPECIAL MEETING MOTION CARRIED 7-0 7. PUBLIC HEARINGS 7.1 Consider approval of Resolution No. 2022-05, approving Development Plan request DEV21-0012 and Variance request VAR22-0004 to allow the development of a new 3,395 square foot two-story commercial building combining two existing parcels. A Variance is requested for a reduction in the required side and front yard setbacks, the development’s floor area ratio (FAR), and on-site parking requirements. The site is located at 212 Front Street (Project Planner: David Crompton). David Crompton, Chief of Planning, presented the staff report and answered Commissioner’s questions. Galen Grant, Architect, presented information on the proposed development plan and answered the Commissioner’s questions. Andrew Katakis, Owner, asked for clarification on the parking. Chair Trujillo opened the item to public comments. There were no public comments. Chair Trujillo closed the item to public comments. Danville Planning Commission – Special Meeting Summary of Actions - Draft March 22, 2022 4 David Crompton, Chief of Planning, addressed the applicant’s request for clarification of parking. The condition of directing occupants to park at the Railroad Ave. parking lot with 8-hour permits will be re-inserted. In addition, the parking verbiage would be part of all lease agreements. MOTION BY COMMISSIONER PALANDRANI, SECOND BY COMMISSIONER COMBS, TO ADOPT RESOLUTION NO. 2022-05, APPROVING DEVELOPMENT PLAN REQUEST DEV21-0012 AND VARIANCE REQUEST VAR22-0004 TO ALLOW THE DEVELOPMENT OF A NEW 3,395 SQUARE FOOT TWO-STORY COMMERCIAL BUILDING COMBINING TWO EXISTING PARCELS. A VARIANCE IS REQUESTED FOR A REDUCTION IN THE REQUIRED SIDE AND FRONT YARD SETBACKS, THE DEVELOPMENT’S FLOOR AREA RATIO (FAR), AND ON-SITE PARKING REQUIREMENTS. THE SITE IS LOCATED AT 212 FRONT STREET. WITH THE ADDITION OF THE FOLLOWING CONDITIONS: • ALLOWABLE PARKING WILL BE IN ACCORDANCE WITH THE CURRENT TOWN STANDARDS FOR LONG-TERM PARKING AND ANY OTHER ACCOMMODATIONS WILL BE THE RESPONSIBILITY OF THE OWNER. • PRIOR TO THE ISSUANCE OF BUILDING PERMITS FOR THE PROJECT, THE APPLICANT SHALL PAY THE TOWN’S OFF-SITE PARKING IN-LIEU FEE FOR REQUIRED OFF-SITE PARKING. THE FEE INCLUDES THE LOSS OF TWO EXISTING ON-SITE PARKING SPACES AND CREDIT FOR TWO PARKING SPACES AT THE OFFICE PARKING DEMAND RATE FOR THE EXISTING 500 SQUARE FOOT BUILDING. THE NEW 3,395 SQUARE FEET OF OFFICE SPACE HAS A PARKING DEMAND OF 1 SPACE PER 225 SQUARE FEET, AND THE 560 SQUARE FOOT MEZZANINE AREA HAS A PARKING DEMAND OF 1 SPACE PER 1, 000 SQUARE FEET. AFTER APPLYING THE TOWN’S 20 PERCENT SHARED PARKING REDUCTION MULTIPLIER, THE TOTAL FEE SHALL BE $165,694.00 • PARKING RELATED TO THIS BUILDING SHALL NOT BE ALLOWED IN THE PRIVATE PARKING LOT ACROSS FRONT STREET AT 185 FRONT STREET, UNLESS AGREED TO BE THAT PROPERTY OWNER. LANGUAGE TO THIS EFFECT SHALL BE Danville Planning Commission – Special Meeting Summary of Actions - Draft March 22, 2022 5 INCLUDED IN ALL LEASE AGREEMENTS FOR THIS BUILDING. • THE FINAL GARBAGE STORAGE DESIGN SHALL BE SUBJECT TO REVIEW AND APPROVAL BY THE SOLID WASTE DISPOSAL PROVIDER AND THE TOWN OF DANVILLE. MOTION CARRIED 7-0 7.2 Consider approval of Resolution No. 2022-06, approving Development Plan request DEV21-0015 allowing the development of a new 3,979 square foot single-family residence on a 3.19-acre parcel located at 1288 Lawrence Road. (Project Planner: Riley Anderson-Barrett) Riley Anderson-Barrett presented the staff report and answered the Commissioner’s questions. Marshall Schneider, Architect, presented information on the proposed development plan and answered the Commissioner’s questions. Chair Trujillo opened the item to public comments. MOTION BY COMMISSIONER GRAHAM SECOND BY COMMISSIONER COMBS TO ADOPT RESOLUTION NO. 2022-06, APPROVING DEVELOPMENT PLAN REQUEST DEV21-0015 ALLOWING THE DEVELOPMENT OF A NEW 3,979 SQUARE FOOT SINGLE-FAMILY RESIDENCE ON A 3.19-ACRE PARCEL LOCATED AT 1288 LAWRENCE ROAD. MOTION CARRIED 7-0 8. REPORTS AND COMMUNICATIONS 8.1 Commissioner Reports Commissioner Combs reported that the 2023 Planning Commissioner’s Academy will be held in Orange County.
