Town Council – Regular Meeting SUMMARY OF ACTIONS Tuesday, April 5, 2022 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Arnerich at 5:00 p.m. The meeting was conducted by teleconference only. 1.1Roll Call City Clerk Marie Sunseri conducted the roll call for attendance. Present: Newell Arnerich, Mayor Robert Storer, Vice Mayor Dave Fong, Councilmember Renee Morgan, Councilmember Karen Stepper, Councilmember 1.2 Announcements City Clerk Marie Sunseri provided information regarding the format of the meeting and instructions for public comment. 2.PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Seng Lovan. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS APRIL 5, 2022 4. FOR THE GOOD OF THE TOWN There were no speakers. 5.PRESENTATIONS AND PROCLAMATIONS 5.1 Presentation of a proclamation to Seng Lovan, Danville Senior Community Library Manager, proclaiming April 3 - 9, 2022 as National Library Week Mayor Arnerich presented the proclamation. 6. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of March 15, 2022 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 22-2022, approving the continued use of teleconferencing for the meetings of all Town legislative bodies pursuant to the provisions of AB 361 6.4Consider adoption of Resolution No. 23-2022, approving the removal of Deferred Improvement Agreement DP 3003-82 for Assessor’s Parcel Number 199-350-038 (321 Hartz Avenue) 6.5Consider adoption of Resolution No. 24-2022, designating the District Engineer, directing preparation of the annual report for fiscal year 2022/23 for the Danville Street Lighting and Landscape Assessment District 1983-1 and approving a contract extension with Francisco & Associates 6.6Consider adoption of Resolution No. 25-2022, approving a Notice of Completion for the Sports Field Lighting Project at Diablo Vista Park, CIP No. B-280 MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER STEPPER, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS APRIL 5, 2022 7. COMMUNICATIONS 8.1Development Services Department Report by Assistant Town Manager Tai Williams Tai Williams provided the report. 9. ADMINISTRATIVE STAFF REPORTS (Public comment invited) 9.1Discussion regarding the status and future of expanded outdoor restaurant seating Chief of Planning David Crompton presented the staff report and responded to questions from the Town Council. Mayor Arnerich opened the item to public comment. The following speakers expressed support for continuing the Temporary Land Use Permits: Judy Lloyd, Danville Area Chamber of Commerce Chris Koenig Scott Edgar Brittany Riley Catherine Cale Randy Negi Dave Homer The following speaker expressed concern for the security and safety of diners in the temporary parklets: Robert S. Robinson 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS APRIL 5, 2022 Mayor Arnerich closed the item to public comment. There was Town Council consensus to direct staff to do the following: 1.Present an ordinance for the Town Council to consider at the May 3, 2022, regular meeting that includes the following; 2.Extend the temporary land use permits through January 3, 2023; 3.Update the ordinance to reflect new dates and COVID-19 restrictions; 4.Include Town Council support for Town Code Enforcement Officer to enforce Town ordinances and the requirements of the Temporary Land Use Permits; 5.Partner with the Danville Area Chamber of Commerce to work with the downtown businesses to maintain the parklets and comply with the requirements of the Temporary Land Use Permits; and 6.Open Church Street to traffic and restrict parklets to the parking spaces. 10.
