Danville Planning Commission – Special Meeting Summary of Actions March 8, 2022 - DRAFT 1. CALL TO ORDER The special meeting of the Danville Planning Commission was called to order by Chair Trujillo at 5:00 p.m. The meeting was conducted by teleconference only. 1.1 Roll Call Administrative Assistant Kristine Meidberg conducted the roll call for attendance: Present: Archie Bowles, Commissioner Robert Combs, Commissioner Bob Ficken, Alt. Commissioner Mark Graham, Commissioner Mary Grace Houlihan, Commissioner Lou Palandrani, Commissioner Paul Radich, Vice Chair Chris Trujillo, Chair Excused: None 1.2 Announcements Administrative Assistant Kristine Meidberg provided information regarding the format of the meeting and instructions for public comment. 2. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Danville Planning Commission – Special Meeting Summary of Actions - Draft March 8, 2022 2 3. “FOR THE GOOD OF THE TOWN” – To address the Planning Commission about a subject which is not listed on the agenda, click on the "Raise Your Hand" option in Zoom. Your name will be announced and you will have up to three (3) minutes to share your comments. There was one public comment. Veronica Benjamin, Danville resident, advocate for the late Tyrell Wilson and Laudemer Arboleda. She would like to create a permanent memorial in Danville and wanted to know how this can be established. David Crompton, Chief of Planning, appreciates her comments but explained that the Planning Commission’s focus is on land use and planning issues only and is unable to take action on matters of memorial plaques and monuments. It would need to go through the Town Council. 4. ITEMS FOR CONSIDERATION/ACTION 4.1 Consider approval of the Summary of Actions from the February 22, 2022, Planning Commission Special meeting. Chair Trujillo noted the designation of the Chair and Vice-Chair were incorrect and needed to be changed MOTION BY COMMISSIONER COMBS, SECOND BY COMMISSIONER GRAHAM TO APPROVE THE SUMMARY OF ACTIONS WITH THE CORRECTION OF THE CHAIR AND VICE-CHAIR DESIGNATIONS, FROM THE FEBRUARY 22, 2022 PLANNING COMMISSION SPECIAL MEETING MOTION CARRIED 7-0 5. PUBLIC HEARINGS 5.1 Consider approval of Resolution No. 2022-03, approving Development Plan request DEV21-0004 allowing for the remodel of the building facade and the construction of permanent awning structures allowing for expanded long- term outdoor seating on the property located at 298 Hartz Ave Riley Anderson-Barrett, Assistant Planner, presented the staff report and answered Commissioner questions. Danville Planning Commission – Special Meeting Summary of Actions - Draft March 8, 2022 3 William Wood, Architect, reviewed the project and addressed the commissioner’s questions Chair Trujillo opened the item to public comments. There was one public comment. Veronica Benjamin, Danville resident, wanted to express concern over the angular bike parking shown. She asks that we consider a different design that would be more secure. William Wood, architect, will look into different designs for bike parking. Chair Trujillo closed the item to public comments. Chair Trujillo brought it back to the Commission for final comments and questions. MOTION BY COMMISSIONER HOULIHAN, SECOND BY COMMISSIONER COMBS, TO ADOPT RESOLUTION NO. 2022-03, APPROVING DEVELOPMENT PLAN REQUEST DEV21-0004 ALLOWING FOR THE REMODEL OF THE BUILDING FACADE AND THE CONSTRUCTION OF PERMANENT AWNING STRUCTURES ALLOWING FOR EXPANDED LONG-TERM OUTDOOR SEATING ON THE PROPERTY LOCATED AT 298 HARTZ AVE WITH THE FOLLOWING MODIFICATIONS: • ARCHITECT TO WORK WITH STAFF ON FURTHER ENHANCING THE BIKE PARKING, INCREASING THE NUMBER AND TRYING TO LOCATE IT AS CLOSE TO THE PUBLIC RIGHT AWAY AS POSSIBLE • TO INCLUDE LANGUAGE REGARDING THE PAYMENT OF THE PARKING FEES SHOULD THERE BE A VIOLATION MOTION CARRIED 7-0 5.2 Consider approval of Resolution No. 2022-04, denying an appeal and upholding the Town’s administrative action denying Variance VAR22-0002 which is a request to allow the retention of an existing six-foot-tall fence Danville Planning Commission – Special Meeting Summary of Actions - Draft March 8, 2022 4 located within the front yard setback area of the property located at 1221 Greenbrook Drive (APN 207-253-004) Riley Anderson-Barrett, Assistant Planner, presented the staff report and answered Commissioner questions. Nick Christian, 1221 Greenbrook Drive property owner presented the appeal of the Town’s administrative action denying the variance request to allow the retention of an existing six-foot-tall fence. Commissioner’s questions were answered. Chair Trujillo opened the item to public comment. There were no public comments. Chair Trujillo brought it back to the Commission for questions and final comments. MOTION BY COMMISSIONER GRAHAM, SECOND BY COMMISSIONER HOULIHAN, TO ADOPT RESOLUTION 2022-04, DENYING AN APPEAL AND UPHOLDING THE TOWN’S ADMINISTRATIVE ACTION DENYING VARIANCE VAR22-0002 WHICH IS A REQUEST TO ALLOW THE RETENTION OF AN EXISTING SIX-FOOT-TALL FENCE LOCATED WITHIN THE FRONT YARD SETBACK AREA OF THE PROPERTY LOCATED AT 1221 GREENBROOK DRIVE MOTION CARRIED 6-1; COMMISSIONER BOWLES OPPOSED 6.
