HomeMy WebLinkAbout2022-01RESOLUTION NO. 2022-01 REVISED FINAL DEVELOPMENT PLAN (DEV21-0010) FOR THE PREVIOUSLY APPROVED 69-LOT MAGEE PRESERVE DEVELOPMENT. THE PROPOSED REVISIONS INCLUDE UPDATES TO THE PREVIOUSLY APPROVED ARCHITECTURAL PLANS, INCLUDING SIX DIFFERENT FLOOR PLANS, EACH WITH THREE OR FOUR ALTERNATE ELEVATION STYLES. THE 410-ACRE SITE IS LOCATED ALONG THE SOUTH SIDE OF DIABLO AND BLACKHAWK ROADS WHEREAS, DAVIDON HOMES, LLC (Owner) and Bassenian-Lagoni (Architect) have requested approval of a Revised Final Development Plan (DEV10-0072)) for the previously approved 69-lot Magee Preserve development. The proposed revisions include updates to the previously approved architectural plans, including six different floor plans, each with three or four alternate elevation styles. The 410-acre site is located along the south side of Diablo and Blackhawk Roads; and WHEREAS, the previously approved Final Development Plan was approved by the Danville Town Council on July 2, 2019; and WHEREAS, the site is located on the south side of Diablo Road and Blackhawk Road extending approximately two miles east from the intersection of Diablo Road/Green Valley Road/McCauley Road; and WHEREAS, the site is also identified as Assessor’s Parcel Numbers 202-050-071, 073, 078, 079, and 080; 202-100-017, 019, 038, and 040; and 215-040-002; and WHEREAS, an environmental impact report, which evaluated potential environmental impacts related to the development, was previously certified by the Town. The proposed architectural modification is a minor alteration to land use limitations for the project and will not result in any changes to land use density. Therefore, the project has been found to be Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA), Section 15305, Class 5; and WHEREAS, the Planning Commission did review the project at a duly noticed public hearing on January 25, 2022; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and DocuSign Envelope ID: B5E115E9-44E4-4B4C-A348-3CA375C12E3B PAGE 2 OF RESOLUTION NO. 2022-01 WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Planning Commission of the Town of Danville approves the Revised Final Development Plan request DEV21-0010 per the conditions contained herein, and makes the following findings in support of this action: FINDINGS OF APPROVAL 1. The proposed development plan will not be detrimental to the health, safety and general welfare of the Town, in that the site is already developed and is connected to all necessary public utilities and is covered and/or has access to all necessary public services and amenities; 2. The proposed development plan will not adversely affect the orderly development of property within the Town, in that the project consists of a previously approved commercial office building which is consistent and compatible with the surrounding land use patterns; 3. The proposed development plan will not adversely affect the preservation of property values and the protection of the tax base within the Town, in that the project will result updated architectural plan which will better match the current housing market; 4. The proposed development plan will not adversely affect the policy and goals as set by the General Plan, in that the proposed office use is consistent with the site’s General Plan land use designation and the site’s P-1; Planned Unit Development District zoning; 5. The proposed development plan shall not create a nuisance and/or enforcement problem within the neighborhood or community, in that the project is consistent with the General Plan, P-1; Planning Unit Development District zoning, and surrounding residential land uses; 6. The proposed project will not encourage marginal development within the neighborhood, in that the project consists with the General Plan, P-1; Planning Unit Development District zoning, and surrounding residential land uses. CONDITIONS OF APPROVAL 1. The approval is for a revised Final Development Plan (DEV21-0010) for the previously approved 69-lot Magee Preserve development. Except as may be modify by the following conditions. Development shall be substantially as shown on the following drawings and plans: A. Architectural floor plans and elevation as prepared by Bassenian – Lagoni, consisting of 54 sheets, dated April 21, 2021. B. Architectural floor plans, elevations, and landscaping for Plans 1 & 2 with ADU as prepared by Bassenian – Lagoni, consisting of six sheets, dated October 22, 2021. C. Colored renderings as prepared by Bassenian – Lagoni, consisting of 21 sheets, on file with the Planning Division. D. Digital color and material boards as prepared by Bassenian – Lagoni, gated June 29, 2021, on file with the Planning Division. E. Site Plan/Plotting plan as prepared by Ruggeri – Jensen – Azar, consisting of three sheets, dated July 29, 2021. 2.Except for the revised architectural plan approve by this Resolution, the development shall continue to be subject all the conditions of approval and mitigation measures approved by the Town Council under Resolution No. 46- 2019.
