HomeMy WebLinkAbout020122-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council February 1, 2022 SUBJECT: Resolution No. 6-2022, amending the construction contract for the Town Office Relocation Project, Contract No. B-626 BACKGROUND The Town is in the process of relocating the Danville Town Offices and Police Department from 510 La Gonda Way to 500 La Gonda Way. The new property includes an office building and an unfinished building shell (previously designed to be a children’s theater) that are connected by a central atrium and plaza, and related parking and landscape improvements. The first phase of this project involves relocating the Police Department. This involves constructing approximately 18,878 square feet of interior tenant improvements to the unfinished building shell. On November 17, 2020, the Town Council adopted Resolution No. 77-2020, awarding a construction contract for the Town Office Relocation Project, Contract No. B-626 (Attachment B) to D.L. Falk Construction, Inc. in the amount of $5,924,000. Inclusion of a 20% contingency in the amount of $1,184,800 brought the total construction contract for this first phase of the work to $7,108,800. DISCUSSION As the tenant improvements for the Police Department are nearing completion, attention is turning to constructing tenant improvements required for the second phase of the project. The second phase of the work includes tenant improvements to the atrium and ground floor of the office building that will house all of the remaining Town departments currently located at 510 La Gonda Way. This phase of the project includes an additional 22,120 square feet of office space. The phase two tenant improvements along with related parking lot improvements are necessary prior to the relocation of all non-Police Town staff. Significant cost and time savings can be realized by amending the current construction contract with D.L. Falk to complete the phase two tenant improvements and parking lot improvements. The following table describes construction costs associated with both phases of the project tenant improvements plus the parking lot. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT No additional fiscal impact. All funds required for the contract amendment have been previously appropriated as part of CIP Project B-626 - Town Office Relocation Project. B-626 WHEREAS, the Danville Town Council previously appropriated funding in the Capital Improvement Program for the Town Office Relocation Project, Contract No. B-626, and WHEREAS, the Town Council adopted Resolution No. 77-2020, awarding a construction contract for the Town Office Relocation Project, to D.L. Falk Construction, Inc; and WHEREAS, significant cost and time savings can be realized by initiating a change order to the Town Office Relocation Project for the improvements of similar scope items at 500 La Gonda office building; and WHEREAS, the total cost of the amendment exceeds the previously approved total construction budget; and WHEREAS, the construction contract with D.L. Falk Construction, Inc. needs to be amended to increase the total authorized construction budget by $1,886,002 resulting in an amended total construction budget of $8,994,802; and WHEREAS, sufficient funds have previously been appropriated by the Town Council in Town Office Relocation Project, Contract No. B-626 to fund the contract amendment; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized to execute, on behalf of the Town, a contract amendment in the amount of $1,886,002 with D.L. Falk Construction, Inc. B-626 WHEREAS, the Danville Town Council has appropriated funding in the Capital Improvement Program for the Town Office Relocation Project, CIP No. B-626; and WHEREAS, the plans and specifications for the subject project have been designed by William Wood Architects, the original designer of the buildings at 500 La Gonda Way; and WHEREAS, the City Clerk of this Town did, in open session on the 5th day of November, 2020, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is DL Falk Construction, Inc. of Hayward, California, and the City Engineer has recommended awarding a contract for the project to said contractor; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Town Office Relocation Project, CIP No. B-626 to DL Falk Construction, Inc. of Hayward, California; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with DL Falk Construction, Inc. for $5,924,000 and authorize use of a 20% construction contingency of $1,184,800 for a total construction budget of $7,108,800 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that staff shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA 94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
