HomeMy WebLinkAbout011122-05.5ADMINISTRATIVE STAFF REPORT 5.5 TO: Mayor and Town Council January 11, 2022 SUBJECT: Resolution No. 2-2022, accepting public and private improvements and dedications for Subdivision 9479, located at the southeast corner of Sherburne Hills Road and Camino Tassajara BACKGROUND On November 19, 2019, the Town Council approved the subdivision map for this 18-lot single family residential development. Construction of the subdivision improvements is now complete. Action by the Town Council is necessary to accept the improvements and dedications. The improvements consist of public and private street paving, the completion of the Fairwood Court Street closure, curb and gutter, sidewalk, curb ramps, storm drainage and treatment facilities, common area landscaping, sound wall, street, and traffic signs. The subdivision map (Attachment B) includes the following offers of dedication: 1.Fieldstone Drive and Camino Tassajara is offered as a public street easement 2.Public Utility Easement (PUE) abutting the public street 3.Emergency Vehicle Access Easement (EVAE) as shown on the final map 4.Relinquishment of Abutters Rights on lot 18 The recommended resolution (Attachment A) accepts all of these dedications on behalf of the Town. Once accepted, the subdivider will have the option of replacing the current performance security with a one-year guarantee. Upon adoption of the resolution, the City Clerk may release the legal security. The payment security may be released in three months if no claims are filed with the City Clerk, and the one-year guarantee (or any remaining performance security) may be released in one year. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. A copy of this Administrative Staff Report has been sent to the subdivider and Surety Company. Acceptance of Subdivision 9479 2 January 11, 2022 Edendale FISCAL IMPACT Upon completion of the project improvements, the Town will be responsible for routine maintenance of 431 LF of street improvements and 1,415 square feet of landscaping. The total fiscal impact to the Town would be approximately $1,168 annually. RECOMMENDATION Adopt Resolution No. 2-2022, accepting public and private improvements and dedications for Subdivision 9479, located at the southeast corner of Sherburne Hills Road and Camino Tassajara. Williams Assistant Town Manager Attachments: A – Resolution No. 2-2022 B – Location Map c: Subdivider: TH – Danville Investors, LLC, 3001 Bishop Drive, Suite 100 San Ramon, CA 94583 Maintenance Department: Dave Casteel, Jim Parke File No. 203-03/9479 RESOLUTION NO. 2-2022 ACCEPTING PUBLIC AND PRIVATE IMPROVEMENTS AND DEDICATIONS FOR SUBDIVISION 9479, LOCATED AT THE SOUTHEAST CORNER OF SHERBURNE HILLS ROAD AND CAMINO TASSAJARA WHEREAS, TH-Danville Investors, LLC, is the subdivider of said subdivision; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete and accept the dedications offered to the Town of Danville on the recorded subdivision map of Subdivision 9479, (542M29); and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider have been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, it is now in the interest of the Town of Danville to: 1.accept those dedications of public streets and other easements on said subdivision map for the benefit and use of the general public; and 2.accept those public and private improvements installed as public facilities for the benefit and use of the general public; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Danville Town Council accepts the following dedications offered for the public benefit within this subdivision: 1.Fieldstone Drive and Camino Tassajara is offered as public street easement 2.Public Utility Easement(s) (PUE) abutting the public streets 3.Emergency Vehicle Access Easement (EVAE) 4.Relinquishment of Abutters Rights on Lot 18 RESOLVED, that the Town of Danville hereby accepts those public improvements installed as a condition of this subdivision agreement; and be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code.
