Town Council – Regular Meeting SUMMARY OF ACTIONS December 21, 2021 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Arnerich at 5:00 p.m. The meeting was conducted by teleconference only. 1.1Roll Call City Clerk Marie Sunseri conducted the roll call for attendance. Present: Newell Arnerich, Mayor Robert Storer, Vice Mayor Dave Fong, Councilmember Renee Morgan, Councilmember Karen Stepper, Councilmember 1.2 Announcements City Clerk Marie Sunseri provided information regarding the format of the meeting and instructions for public comment. 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Vice Mayor Storer. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. City Clerk Marie Sunseri stated that public comment was received from 350 Contra Costa and was distributed to the Town Council in advance of the meeting. 5. CONSENT CALENDAR 5.1Consider approval of the Summary of Actions from the regular Town Council meeting of November 16, 2021 5.2Consider approval of the Summary of Actions from the special Town Council meeting of December 7, 2021 5.3Consider approval of the Summary of Actions from the regular Town Council meeting of December 7, 2021 5.4Consider approval of the Summary of Actions from the special Town Council meeting of December 14, 2021 5.5Consider approval of the Register of Demands 5.6Consider acceptance of the October 2021 Month End Treasurer’s Report 5.7Consider adoption of Resolution No. 80-2021, approving Minor Subdivision Map MS 853-2021, located at 2460 Tassajara Lane 5.8Consider adoption of Resolution No. 81-2021, authorizing the purchase and installation of five (5) electronic radar speed display driver feedback signs for Sycamore Valley Road, San Ramon Valley Boulevard and Greenbrook Drive as part of Traffic Management Program, C-305 5.9Consider adoption of Resolution No. 82-2021, awarding a construction contract for the 2020/21 Pavement Resurfacing (ARAM - Cape Seal and Slurry Seal) Project, CIP No. C-610E 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 21, 2021 5.10Consider adoption of Resolution No. 83-2021, approving the continued use of teleconferencing for the meetings of all Town legislative bodies pursuant to the provisions of AB 361 5.11Consider adoption of Ordinance No. 2021-04, repealing existing Chapter 32-80 of the Danville Municipal Code and adding a new Chapter 32-80 to the Danville Municipal Code adopting the California Model Water Efficient Landscape Ordinance 5.12Consider adoption of Resolution No. 84-2021, approving out-of-state travel to attend the 2022 U.S. Conference of Mayors' Annual Winter Meeting and Annual Tri-Valley Mayors' Legislative Briefings in Washington, D.C., January 19-21, 2022 MOTION BY COUNCILMEMBER STEPPER, SECOND BY COUNCILMEMBER FONG, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 6. TOWN MANAGER’S REPORT 6.1 Monthly Town Manager’s report by Joe Calabrigo Town Manager Joe Calabrigo provided the update. 7. COMMUNICATIONS 7.1Police Department Report by Chief Allan Shields Police Chief Allan Shields provided the report. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 21, 2021 8. PUBLIC HEARINGS 8.1Consider adoption of Ordinance No. 2021-05, an urgency ordinance temporarily suspending outdoor seating limitations for restaurant uses within the Town of Danville, authorizing extension of temporary land use permits and extending street closures with a waiver of Danville Ordinance No. 96-10 Chief of Planning David Crompton presented the staff report and responded to questions from the Town Council. Mayor Arnerich opened the item to public comment. The following individuals addressed the Town Council: Doug Offenhartz Judy Lloyd, Danville Area Chamber of Commerce Glenn Bittner Darren Matte Brittany Riley Keva Dodd Tim Argenti Uday Kumar Dave Homer Mayor Arnerich closed the item to public comment. The Town Council discussed concerns related to the restaurants and parklets, and directed staff to highlight areas of concern in the ordinance. There was consensus to extend the Temporary Land Use Permits. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 21, 2021 MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER STEPPER, TO ADOPT AND READ BY TITLE ONLY ORDINANCE NO. 2021-05, AN URGENCY ORDINANCE TEMPORARILY SUSPENDING OUTDOOR SEATING LIMITATIONS FOR RESTAURANT USES WITHIN THE TOWN OF DANVILLE, AUTHORIZING EXTENSION OF TEMPORARY LAND USE PERMITS AND EXTENDING STREET CLOSURES WITH A WAIVER OF DANVILLE ORDINANCE NO. 96-10; EXTEND TO JUNE 30, 2022, AND RETURN TO THE TOWN COUNCIL FOR REVIEW ON APRIL 5; AND, HIGHLIGHT AND/OR INCLUDE AREAS OF CONCERN IN THE ORDINANCE MOTION CARRIED 5-0 8.2Consider adoption of Resolution No. 85-2021, identifying applicable objective development standards, subdivision standards, design standards, and minimum submittal requirements related to the implementation of the mandated requirements of State Senate Bill 9 Chief of Planning David Crompton presented the staff report and answered questions from the Town Council. MOTION BY VICE MAYOR STORER, SECOND BY COUNCILMEMBER FONG, TO ADOPT RESOLUTION NO. 85-2021, IDENTIFYING APPLICABLE OBJECTIVE DEVELOPMENT STANDARDS, SUBDIVISION STANDARDS, DESIGN STANDARDS, AND MINIMUM SUBMITTAL REQUIREMENTS RELATED TO THE IMPLEMENTATION OF THE MANDATED REQUIREMENTS OF STATE SENATE BILL 9; INCLUDING MINOR REVISIONS MOTION CARRIED 5-0 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 21, 2021 9. ADMINISTRATIVE STAFF REPORTS 9.1Consider proposed Solid Waste and Recycling rates for 2022 (Rate Year 8) and forward a recommendation for a 2% rate increase to the Recycle Smart Joint Powers Authority Deputy Town Manager Diane Friedmann presented the staff report. MOTION BY COUNCILMEMBER STEPPER, SECOND BY COUNCILMEMBER MORGAN, TO FORWARD A RECOMMENDATION FOR A 2% RATE INCREASE TO THE RECYCLE SMART JOINT POWERS AUTHORITY FOR SOLID WASTE AND RECYCLING RATES FOR 2022 (RATE YEAR 8) MOTION CARRIED 5-0 10.
