CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan at 5:00 p.m. The meeting was conducted by teleconference only. 1.1 Roll Call City Clerk Marie Sunseri conducted the roll call for attendance. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Dave Fong, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 1.2 Announcements City Clerk Marie Sunseri provided information regarding the format of the meeting and instructions for public comment. She stated that no written public comments were received on any item on the agenda in advance of this meeting. 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Kathy Chiverton. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. FOR THE GOOD OF THE TOWN Zae Perrin, Danville, described the harassment of his daughter, currently a student at San Ramon Valley High School, which occurred during her tenure in the San Ramon Valley Unified School District, and the lack of response from the school district administration. Judy Lloyd, Danville Area Chamber of Commerce, expressed support for Mr. Perrin and his family; commended the Town for being designated a Purple Heart Community; and, encouraged the Town to extend temporary outdoor seating beyond the January 3, 2022 expiration. There was Town Council consensus to direct staff to add an item to the December 21, 2021 meeting agenda to consider further extending temporary restaurant seating. 5. CONSENT CALENDAR Councilmember Stepper removed item 5.1 for discussion. 5.1 Consider approval of the Summary of Actions from the regular Town Council meeting of November 2, 2021 REMOVED 5.2 Consider approval of the Register of Demands 5.3 Consider acceptance of the September 2021 Month End Treasurer's Report 5.4 Consider adoption of Ordinance No. 2021-03, amending Sections 3-8.5 and 3-8.6 of the Danville Municipal Code regarding purchasing and contracting 5.5 Consider adoption of Resolution No. 74-2021, re -approving the Town of Danville Investment Policy 5.6 Consider adoption of Resolution No. 77-2021, appropriating funds and authorizing the Town Manager to execute a contract for a replacement to the Town's current Storage Area Network System (SANS) in line with technology improvements associated with CIP Project B-626 - Town Office Relocation 2 DocuSign Envelope ID: B41965F1-049B-464E-AC04-8836C8FBAF81 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 16, 2021 MOTION BY VICE MAYOR STORER, SECOND BY COUNCILMEMBER STEPPER, TO APPROVE THE CONSENT CALENDAR ITEMS 5.2 THROUGH 5.6 MOTION CARRIED 5-0 ITEM 5.1 - CONSIDER APPROVAL OF THE SUMMARY OF ACTIONS FROM THE REGULAR TOWN COUNCIL MEETING OF NOVEMBER 2, 2021 REMOVED FOR DISCUSSION Councilmember Stepper stated that she believes that the Summary of Actions that were prepared for the November 2, 2021 Town Council meeting should have included Town Council comments and direction to the restaurant owners for steps to take to permit their outdoor seating areas. MOTION BY COUNCILMEMBER STEPPER, SECOND BY COUNCILMEMBER STORER, TO APPROVE ITEM 5.1 AND MODIFY, IF DEEMED APPROPRIATE MOTION CARRIED 5-0 6. COMMUNICATIONS 6.1 Measure X update by Measure X Advisory Board Member Kathy Chiverton Kathy Chiverton provided the report. 6.2 RecycleSmart presentation by Judith Silver, Senior Waste Prevention and Recycling Manager Judith Silver provided the report. 7. PUBLIC HEARINGS 7.1 Consider introduction of Ordinance No. 2021-04, repealing existing Chapter 32-80 of the Danville Municipal Code and adding a new Chapter 32-80 to the Danville Municipal Code adopting the California Model Water Efficient Landscape Ordinance City Attorney Rob Ewing presented the staff report. 3 DocuSign Envelope ID: B41965F1-049B-464E-AC04-8836C8FBAF81 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 16, 2021 Mayor Morgan opened the item to public comment. MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER FONG, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2021-04, REPEALING EXISTING CHAPTER 32-80 OF THE DANVILLE MUNICIPAL CODE AND ADDING A NEW CHAPTER 32-80 TO THE DANVILLE MUNICIPAL CODE ADOPTING THE CALIFORNIA MODEL WATER EFFICIENT LANDSCAPE ORDINANCE, AND RETURN FOR SECOND READING ON DECEMBER 21, 2021 MOTION CARRIED 5-0 8. ADMINISTRATIVE STAFF REPORTS 8.1 Consider adoption of Resolution No. 75-2021, approving the Fiscal Year 2020/21 Audited Annual Comprehensive Financial Report for the Town of Danville Finance Director/Treasurer Lani Ha and Coley Delaney, Pun Group, presented the staff report and provide highlights of the Fiscal Year 2020/21 Audited Annual Comprehensive Financial Report for the Town of Danville. MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT RESOLUTION NO. 76-2021, APPROVING A RECOVERED ORGANIC WASTE PRODUCT PROCUREMENT POLICY AS REQUIRED BY SB 1383 AND REGULATIONS TO IMPLEMENT THE POLICY MOTION CARRIED 4-1; COUNCILMEMBER STEPPER OPPOSED 9. TOWN COUNCIL REPORTS 9.1 Town Council updates Councilmembers provided an update on events and activities in Danville. 10. ADJOURN TO DANVILLE DISASTER COUNCIL At 7:45 p.m. the regular meeting of the Danville Town Council was adjourned to a meeting of the Danville Disaster Council. 11.
