HomeMy WebLinkAbout068-2021DocuSign Envelope ID: 116F9482-6B04-4623-BC03-1 F7D949CF277 RESOLUTION NO. 68-2021 GRANTING CONSENT TO THE CITY OF LIVERMORE TO ESTABLISH AND INCLUDE THE TOWN OF DANVILLE IN THE LIVERMORE VALLEY WINE HERITAGE DISTRICT (LVWHD) WHEREAS, the City of Livermore is working with the Livermore Valley Wine Association and local winery businesses to form the Livermore Valley Wine Heritage District (LVWHD) pursuant to the Property and Business Improvement District Law of 1994 (the 94 Law), Streets and Highways Code section 36600 et seq., to provide specific benefits to assessed winery businesses in Livermore Valley Wine Country; and WHEREAS, the 94 Law allows for the formation of multi -jurisdictional Business Improvement Districts (BIDs) with consent of the included jurisdictions being granted to one "lead" jurisdiction; and WHEREAS, the City of Livermore has requested consent to act as the lead jurisdiction in the formation of the LVWHD in the Town of Danville; and will follow the formation proceedings specified in the 94 Law; and WHEREAS, the City of Livermore has requested by resolution the inclusion of the Town of Danville in the LVWHD since Danville town limits are located within the Livermore Valley American Viticultural Area (AVA); and WHEREAS, the LVWHD shall include wineries located within the boundaries of the Counties of Alameda and Contra Costa, the Town of Danville and the cities of Livermore, Dublin and Sunol; WHEREAS, the City of Livermore has provided written notice to two Danville businesses with winery sales advising them of the intention to establish the LVWHD; WHEREAS, the established LVWHD will have a five (5) year term, beginning July 1, 2021, and ending on June 30, 2026. WHEREAS, beginning July 1, 2021 an annual assessment of two percent (2%) of gross sales revenue on winery sales made within the State of California will be implemented for marketing and brand awareness; community and industry advocacy; quality enhancement and education; and professional development and education efforts for promoting assessed wineries in the LVWHD and increasing winery sales revenue; WHEREAS, adopting this resolution will give the City of Livermore authority to include the Town of Danville in the proposed LVWHD; now, therefore, be it DocuSign Envelope ID: 116F9482-6B04-4623-BC03-1 F7D949CF277 RESOLVED, that the Town of Danville hereby allows City of Livermore to form and include the Town of Danville in the Livermore Valley Wine Heritage District; and be it further RESOLVED, that City of Livermore shall act as the lead jurisdiction in the formation of the LVWHD and is hereby authorized to promote assessed wineries in the LVWHD and collect winery sales revenue; and be it further RESOLVED, that the Danville City Clerk is hereby directed to transmit a certified copy of this resolution to the City Clerk of the Livermore City Council; and be it further RESOLVED, that this resolution is effective upon its adoption.
