HomeMy WebLinkAbout101921-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council October 19, 2021 SUBJECT: Resolution No. 66-2021, awarding a professional services agreement for environmental services for the Diablo Trail Project, CIP Project C-055 BACKGROUND The Town’s Capital Improvement Program (CIP) includes the Diablo Road Trail from Alameda Diablo to Tank Access Road, CIP Project C-055. This project consists of the construction of a paved 0.9-mile Class I pedestrian/bicycle path located adjacent to the south side of Diablo Road from Fairway Drive to the west of the tank access road (1,200 feet west of Mt. Diablo Scenic/Blackhawk intersection) to the east. The proposed path will connect to the existing 0.5-mile Diablo Road (aka Barbara Hale) Trail to the west and a new 0.7-mile Class I path to the east that will be constructed as part of the Magee Preserve Development. The preliminary design of the project is complete, and the project is now in the environmental phase. Per the California Environmental Quality Act (CEQA) the Town must disclose and evaluate the significant environmental impacts of proposed projects and adopt all feasible measures to mitigate those impacts. DISCUSSION Kimley-Horn and Associates, Inc. was previously contracted to complete a biological resources report to provide analysis of special-status species and habitats within the project area for the western section of the trail, a 0.21-mile section of the proposed path adjacent to the creek. The Town now desires to extend Kimley-Horn and Associates services to assist in completing the remaining environmental requirements including Cultural Resources records search, archaeological survey report, aquatic resource jurisdictional delineation, regulatory permit applications, and CEQA document (Initial Study and Mitigated Negative Declaration). PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. Diablo Road Trail 2 October 19, 2021 Environmental Services (CIP No. C-055) FISCAL IMPACT The amount for the environmental services contract is $131,200. An additional 10% contingency in the amount of $14,000 will be reserved for a total environmental services budget of $145,200. Sufficient funds to cover the environmental services contract and contingency are contained in the Diablo Road Trail Project, CIP No. C-055 (Attachment B). RECOMMENDATION Adopt Resolution No. 66-2021 awarding a professional services agreement for environmental services for the Diablo Trail Project, CIP Project C-055. Williams Assistant Town Manager Attachments: A - Resolution No. 66-2021 B - CIP Page No. C-055 RESOLUTION NO. 66-2021 AWARDING A PROFESSIONAL SERVICES AGREEMENT FOR ENVIRONMENTAL SERVICES FOR THE DIABLO TRAIL PROJECT, CIP PROJECT C-055 WHEREAS, the Danville Town Council previously appropriated funding for the Diablo Road Trail Project, CIP No. C-055, in the adopted 2020/21 Capital Improvement Program; and WHEREAS, the California Environmental Quality Act (CEQA) requires that state and local agencies disclose and evaluate the significant environmental impacts of proposed projects; and WHEREAS, CEQA requires the Town to disclose and evaluate any significant environmental impacts of the proposed project and adopt all feasible measures to mitigate those impacts; and WHEREAS, the Town must adopt all feasible measures to mitigate environmental impacts of the proposed project to obtain environmental clearances and permits for project construction; and WHEREAS, the Town desires to hire Kimley-Horn and Associates, Inc. of Pleasanton, CA to assist the Town in completing the environmental clearances and permits for project construction; now, therefore, be it RESOLVED, by the Danville Town Council that the Town Manager is authorized to execute on behalf of the Town, a Professional Services Agreement with Kimley-Horn and Associates, Inc. of Pleasanton, CA with a not-to-exceed budget of $131,200, and that the Town Manager be authorized to establish and utilize a 10% design contingency in the amount of $14,000 for additional work that may be subsequently approved by contract amendment. This project mitigates the impacts of development within the NERIAD project boundaries.Additional worker hours required to maintain per year:0 Additional Town direct operating costs per year:$0 This project has been modified from the previous year. This project is part of the North East Roadway Improvement Assessment District (NERIAD). It provides for an asphalt pedestrian/bicycle multi-use path that would traverse along the south side of Diablo Road from the vicinity of the Fairway Drive/Calle Arroyo intersections to the west of the EBMUD tank access road (1,200 feet west of Mt. Diablo Scenic Blvd.) to the east. The project was deferred until right-of-way dedication was feasible. Right-of-way dedication will now occur in conjunction with the Davidon Homes development along Diablo Road. A feasibility study was completed in 2018 that identified three route options. All options include a pedestrian/bicycle crossing on Diablo Road, Green Valley Creek bridge crossing(s), and path alignment options. Project design to begin in FY 2021.
