SUBJECT: Resolution No. 50-2021, approving a one-year time extension for
previously approved Preliminary Development Plan – Rezoning
application PUD15-0001 for the 1.88-acre site identified as 359 and 375
West El Pintado (GMMR, LLC)
DESCRIPTION
On July 16, 2019, the Town Council held a public hearing and approved the introduction
of Ordinance No. 2019-07 rezoning a 1.88-acre site, located at 359 and 375 West El Pintado,
from R-15; Single Family Residential District and P-1; Planned Unit Development District
to a new P-1; Planned Unit Development District. The Town Council also approved
Resolution No. 55-2019 Certifying a Final Environmental Impact Report and approving
General Plan Amendment (GPA15-0001), Major Subdivision (SD9399), Final
Development Plan (DP15-0065), and Tree Removal (TR15-0039) requests allowing a 37-
unit townhouse development.
On August 13, 2019, the Town held the second reading and adopted Ordinance No. 2019-
07.
EVALUATION
The Town’s P-1; Planned Unit Development District Ordinance specifies that a P-1
district shall become null and void and shall revert to the immediate proceeding zoning
designation if construction specified under the final development plan has not been
commenced within twelve months of its approval. The Town Council may grant up to
five extensions, each extension for not more than one year, upon showing of good cause.
This proposed time extension would be the second one-year time extension.
In the time extension request letter, the applicant states that the extension of time is
necessary to allow for continued discussion with potential development partners for
construction of the project (Attachment B).

Posting of the meeting agenda serves as a notice to the general public.

Adopt Resolution No. 50-2021, approving a one-year time extension for previously
approved Preliminary Development Plan – Rezoning application PUD15-0001 for the
1.88-acre site identified as 359 and 375 West El Pintado (GMMR, LLC)

RESOLUTION NO. 50-2021
APPROVING A ONE-YEAR TIME EXTENSION FOR PREVIOUSLY APPROVED
PRELIMINARY DEVELOPMENT PLAN – REZONING APPLICATION
PUD15-0001 FOR THE 1.88-ACRE SITE IDENTIFIED AS
359 AND 375 WEST EL PINTADO (GMMR, LLC)
(APN: 200-140-011, 012)
WHEREAS, GMMR LLC (Owner) has requested approval of a one-year time extension
for a previously approved Preliminary Development Plan – Rezoning application
(PUD15-0001) as approved under Town Council Ordinance No. 2019-07; and
WHEREAS, the Town Council approval also included a General Plan Amendment
(GPA15-0001), Major Subdivision, and Final Development Plan (DP15-0065) collectively
allowing for the development of a 37-unit townhouse development; and
WHEREAS, Town Council Ordinance No. 2019-07 was introduced on July 16, 2019 and
adopted on August 13, 2019; and
WHEREAS, the Town’s P-1; Planned Unit Development District Ordinance specifies that
a P-1 district shall become null and void, and shall revert to the immediate proceeding
zoning designation, if construction specified under the final development plan has not
been commenced within twelve months of its approval; and
WHEREAS, the Town Council may grant up to five extensions, each extension for not
more than one year, upon showing of good cause; and
WHERAS, this approval constitutes the second one-year time extension, extending the
approval until August 13, 2022; and
WHEREAS, a staff report was submitted recommending that the Town Council approve
the one-year time extension request; and
WHEREAS, at the meeting of August 17, 2021 the Town Council considered the one-year
time extension request; and
WHEREAS, notification of this meeting was provided in compliance with all
requirements of the law; now, therefore, be it
RESOLVED that the Town Council approves a one-year time extension of Preliminary
Development Plan – Rezoning approval PUD15-0001, as contained within Town Council
Ordinance No. 2019-07.

Dear David,
We are requesting an extension for our Entitlement/Tentative Map Approval for the lots located at 359
and 375 West El Pintado in Danville. The Approval was granted on July 16, 2019.
The reason we are asking for an extension is we are continuing discussions with potential Development
Partners to move forward with the project, including attaining Final Map Approval and building the
project to completion. We are also in the process of submitting entitlement drawings and applications
to the Regional Water Control Board, DFW and Army Corp of Engineers.
