TOWN COUNCIL - REGULAR MEETING
SUMMARY OF ACTIONS
JULY 6, 2021
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Morgan at 5:00 p.m. The meeting was conducted by teleconference only.
1.1 Roll Call
Administrative Assistant Kristine Meidberg conducted the roll call for attendance.
Present: Renee Morgan, Mayor
Newell Arnerich, Vice Mayor
Dave Fong, Councilmember
Karen Stepper, Councilmember
Robert Storer, Councilmember
All Councilmembers were present.
1.2 Announcements
Administrative Assistant Kristine Meidberg provided information regarding the
format of the meeting and instructions for public comment.
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance to the flag was led by Jane Joyce, Chair of the Parks,
Recreation and Arts Commission.
3. CHANGES TO THE ORDER OF THE AGENDA
There were no changes to the order of the agenda.

5. PRESENTATIONS AND PROCLAMATIONS
5.1 Presentation of a proclamation to Jane Joyce, Chair, Danville Parks,
Recreation and Arts Commission, proclaiming July as Parks Make Life
Better! Month
Mayor Morgan presented the proclamation.
6. CONSENT CALENDAR
6.1 Consider approval of the Summary of Actions from the regular Town
Council meeting of June 15, 2021
6.2 Consider approval of the Register of Demands
6.3 Consider adoption of Resolution No. 33-2021, approving Subdivision Map
SD 9566 for condo purposes, located at 321 Hartz Avenue
6.4 Consider adoption of Resolution No. 34-2021, authorizing amendment and
novation agreement between Municipal Resource Consultants and
MuniServices, LLC for examination of sales, transactions and use tax
records
6.5 Consider adoption of Resolution No. 35-2021, approving the State of
California Governor's Office of Emergency Services Designation of
Applicant's Agent Resolution (Cal OES Form 130)
6.6 Consider adoption of Resolution No. 36-2021, approving Subdivision Map
and Subdivision Improvement Agreement for Subdivision 9544, located at
134 El Dorado Avenue
6.7 Consider adoption of Resolution No. 39-2021, approving the 2021/22
Operating Budget and setting the 2021/22 Appropriation Limit

STEPPER, TO APPROVE THE CONSENT CALENDAR ITEMS 6.1 THROUGH 6.7

Mayor Morgan stated that the Brown Act requires that before changes in salary or
compensation can become effective for the Town Manager, City Attorney or department
heads, the Town Council shall verbally summarize those changes. As part of the Town
Council's adoption of the Town's Operating Budget for fiscal year 2021/22, the Town
approved changes to salary ranges for a number of employee classifications. While these
changes had been verbally spelled out and discussed during publicly noticed budget
study sessions, we inadvertently neglected to provide that oral summary on June 15, 2021
when the budget was adopted. To address that oversight, I will list the applicable
changes: the salary range for the Assistant Town Manager was set at $11,952 to $16,374;
the salary range for all department heads was set at $10,840 to $14,852; the salary range
for the Deputy Town Manager was set at $8,631 to $11,824; there were no changes to
fringe benefits for any employees and there were no changes in compensation of any kind
for the Town Manager or City Attorney. For the positions listed, only the salary ranges
were changed. Any actual increase in compensation will be determined under the
Town's Pay for Performance system, there are no automatic increases or cost of living
adjustments.
7. TOWN MANAGER'S REPORT
7.1 Monthly Town Manager's report by Joe Calabrigo
Joe Calabrigo provided the report.
8. PUBLIC HEARINGS
8.1 Consider adoption of Ordinance No. 2021-02, an urgency
ordinance temporarily suspending outdoor seating limitations for
restaurant uses within the Town of Danville, authorizing extension of
temporary land use permits and extending street closures with a waiver of
Danville Ordinance No. 96-10
Chief of Planning David Crompton presented the staff report and
background on the proposed recommendation.

Mayor Morgan closed the item to public comment.
Vice Mayor Arnerich encouraged business owners to work with their
adjacent neighbors to maintain visibility for all businesses adjoining the
parklets.
Councilmember Fong encouraged the businesses to increase the visual
appeal of the parklets and the surrounding areas to aid in the overall
beautification of the downtown.
There was Town Council consensus in support of the ordinance.

LAND USE PERMITS AND EXTENDING STREET CLOSURES WITH A WAIVER OF
DANVILLE ORDINANCE NO. 96-10

9. ADMINISTRATIVE STAFF REPORTS
9.1 Consider adoption of Resolution No. 37-2021, approving the Townwide
Bicycle Master Plan, CIP C-609
Transportation Manager Andrew Dillard presented the staff report.

Vice Mayor Arnerich suggested adding language to the Plan indicating that it is a living
document that will be updated as needed in the future.
There was Town Council consensus to approve the Plan.

9.2 Consider adoption of Resolution No. 38-2021, authorizing the Town
Manager to submit an appeal of Danville's 6th Cycle Draft Regional
Housing Needs Assessment (RHNA) Allocation
Assistant Town Manager Tai Williams presented the staff report, provided
background on the RHNA allocation, and answered questions by the Town
Council.
Mayor Morgan opened the item to public comment.
There were no speakers.

There was significant Town Council discussion regarding the RHNA methodology and
the process to appeal and there was Town Council consensus to adopt the Resolution.

11. ADJOURNMENT
The regular meeting of the Danville Town Council was adjourned at 7:50 p.m. in honor
of former Senator and Contra Costa County Sheriff Richard Rainey.
