TOWN COUNCIL - REGULAR MEETING
SUMMARY OF ACTIONS
JUNE 15, 2021
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Morgan at 5:00 p.m. The meeting was conducted by teleconference only.
1.1 Roll Call
City Clerk Marie Sunseri conducted the roll call for attendance.
Present: Renee Morgan, Mayor
Newell Arnerich, Vice Mayor
Dave Fong, Councilmember
Karen Stepper, Councilmember
Robert Storer, Councilmember
All Councilmembers were present.
1.2 Announcements
City Clerk Marie Sunseri provided information regarding the format of the
meeting and instructions for public comment.
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance to the flag was led by Chief of Planning David Crompton.

3. CHANGES TO THE ORDER OF THE AGENDA
Town Manager Joe Calabrigo recommended that item 8.1 follow the Consent
Calendar due to the number of community members intending to speak on the
item.

4. FOR THE GOOD OF THE TOWN
Mayor Morgan noted that one written comment For the Good of the Town was
received by the Town Council in advance of the meeting.
The following speakers commented on the incident with the Danville Police
Department that occurred on March 11, 2021:

5. CONSENT CALENDAR
5.1 Consider approval of the Summary of Actions from the regular Town
Council meeting of June 1, 2021
5.2 Consider approval of the Register of Demands
5.3 Consider acceptance of the April 2021 Month End Treasurer's Report
5.4 Consider adoption of Resolution No. 26-2021, awarding a contract for Zone
D - Park Landscape Maintenance Services
5.5 Consider adoption of Resolution No. 27-2021, awarding a contract for Fleet
Maintenance Services of Town -owned vehicles
5.6 Consider authorizing letter in support of allocating Countywide Measure
X funds to support the Community Crisis Initiative

8. INFORMATIONAL STAFF REPORTS (AGENDA ORDER CHANGED)
8.1 Status of expanded outdoor space for restaurant seating, outdoor personal
service and fitness uses
Town Manager Joe Calabrigo presented the staff report and answered
questions from the Town Council.
Mayor Morgan stated that public comments were received by the Town
Council prior to the meeting and opened the item to public comment.
The following speakers expressed support for parklets and extending the
temporary land use permits (TLUPs):

The following speaker expressed concern regarding the parklets:
Brian Walker
City Attorney Rob Ewing responded to questions raised regarding the
Governor's extension of "Cocktails to Go" and drinking in outdoor areas.
Mr. Calabrigo stated that he has not been made aware of any significant
safety issues in relation to the parklets.
The Town Council expressed support for extending the TLUPs on public
and private property through January 3, 2022; directed staff to return to the
Town Council on July 6 to introduce an urgency ordinance to extend the

TLUPs past the August 1, 2021 expiration deadline, review logistics, and
discuss provisions for Conditions of Approval that require periodic status
reports to the Town Council during the extension period.
It was reiterated that permanent LUP requests must go through the
Planning Commission which is a long-term process with a more complex
discussion.
6. COMMUNICATIONS
6.1 Legislative update by Assistant to the Town Manager Diane Friedmann
Diane Friedmann provided an update.
7. PUBLIC HEARINGS
7.1 Consider adoption of Resolution No. 28-2021, confirming the diagram and
assessment and ordering the levy of the annual assessment, for Danville
Street Lighting and Landscape Assessment District No. 1983-1
Maintenance Services Director Dave Casteel presented the staff report and
answered questions from the Town Council.
Mayor Morgan opened the item to public comment.

7.2 Consider adoption of Resolution No. 29-2021, approving the 2021/22
Operating Budget and setting the 2021/22 Appropriation Limit, Resolution
No. 30-2021, approving the 2021/22 through 2025/26 Capital Improvement
Program and appropriating funds for 2021/22 Capital projects; Resolution
No. 31-2021SA, approving the 2021/22 Operating Budget for the Successor
Agency to the former Community Development Agency of the Town of
Danville; and, Resolution No. 32-2021, approving the 2021/22 Master Fee
Schedule for User and Cost Recovery Fees (J. Calabrigo/L. Ha)
Town Manager Joe Calabrigo presented the staff report, discussed the
budget and CIP process, stated that the Town Council reviewed the
Operating Budget and CIP in five public study sessions, and answered
questions from the Town Council.

It was noted that Councilmember Stepper has a conflict of interest on one
project, B-556 Danville South Park, due to the proximity of her residence to
the project location, and will be abstaining on voting on the additional
appropriation of $70,000.
