TO: Mayor and Town Council July 20, 2021
SUBJECT: Resolution No. 41-2021 appropriating funds and authorizing the Town
Manager to execute a contract for consultant services for the preparation of
a Programmatic Environmental Impacts Report related to the adoption of
the 2023-2031 General Plan Housing Element
BACKGROUND
As required by State Law, all cities and counties must maintain a General Plan Housing
Element which plans for the housing needs of its residents. The California Department of
Housing and Community Development distributes a Regional Housing Needs Allocation
(RHNA) to regional governments on an eight-year cycle. In turn, the regional governments
develop a methodology for the distribution of the housing units to individual cities and
counties, and local cities and counties must adopt a Housing Element which accommodates
the RHNA.
In order for the Town to meet its RHNA, a number of parcels throughout the Town will
need to be considered for General Plan land use designation amendments and associated
rezoning’s to provide for additional housing development sites. Potential environmental
impacts associated with any General Plan or zoning changes need to be studied within a
Programmatic Environmental Impact Report (PEIR).
DISCUSSION
The Town desires to hire a consultant to assist the Town in the preparation of the PEIR.
The Town sent a request for proposals to three firms specializing in the preparation of
PEIRs, and selected the firm of David J. Powers & Associates, Inc. The total cost for the
consulting services would be $266,310.

FISCAL IMPACT
All costs associated with the environmental services for the preparation of the PEIR would
be appropriated from a combination of LEAP grant funding previously secured by the
Environmental Consulting Services 2 July 20, 2021
Town and Town’s Comprehensive Planning Fee Fund.
RECOMMENDATION
Adopt Resolution No. 41-2021 appropriating funds and authorizing the Town Manager to
execute a contract for consultant services for the preparation of a Programmatic
Environmental Impacts Report related to the adoption of the 2023-2031 General Plan
Housing Element.

APPROPRIATING FUNDS AND AUTHORIZING
THE TOWN MANAGER TO EXECUTE A CONTRACT FOR CONSULTANT
SERVICES FOR THE PREPARATION OF A PROGRAMMATIC
ENVIRONMENTAL IMPACTS REPORT RELATED

WHEREAS, all cities and counties in California must maintain a General Plan Housing

WHEREAS, the California Department of Housing and Community Development
distributes a Regional Housing Needs Allocation (RHNA) to regional governments on an
eight-year cycle. In turn, the regional governments develop a methodology for the
distribution of the housing units to individual cities and counties; and
WHEREAS, local cities and counties must adopt a Housing Element which
accommodates the RHNA; and
WHEREAS, in order for the Town to meet its RHNA assignment, a number of parcels
throughout the Town will need to be considered for General Plan land use designation
amendments and associated rezoning’s to provide for additional housing development
sites; and
WHEREAS, potential environmental impacts associated with any General Plan or zoning
changes need to be studied within a Programmatic Environmental Impact Report (PEIR);
and
WHEREAS, the Town desires to hire a consultant to assist the Town in the preparation
of the PEIR; and
WHEREAS, after soliciting proposals from qualified environmental consulting firms, the
Town desires to enter into a contract the firm of David J. Powers & Associates Inc.; now,
therefore, be it
RESOLVED, that the Danville Town Council authorizes the Town Manager to execute
an agreement with David J. Powers & Associates, Inc. for environmental services
associated with the preparation of a PEIR related to the Town 2023-2031 General Plan
Housing Element; and be it further

RESOLVED, that $266,310 is appropriated from a combination of LEAP grant funding
previously secured by the Town and Town’s Comprehensive Planning Fee Fund.
