Planning Commissioners,
We received the notice of the public hearing of the Danville Planning Commission on July 13
regarding Case File No TR21-0012, appeal of a decision to deny a tree removal request for aprotected Valley Oak at 459 Love Lane. We are not able to do a teleconference of the meeting, butwould like to provide input to the property owner's appeal of his tree permit request.
As 30-plus year residents of Danville, we applaud the Danville Tree Ordinance as it aims to preservelarger native trees that provide natural beauty and that have both created and represent the identityand personality of our town, yet still provide a method for property owners to have these treesremoved under certain narrow circumstances.
The town has seven criteria that are considered for approval of a tree removal application. The treein question – a large Valley Oak at 459 Love Lane – does not meet any of these criteria for grantingremoval, and we agree the town made the correct decision in denying the application. Specifically:
The tree is a healthy tree, away from nearby structures and no threat to them.
The tree is located at the very edge of the property along the shared driveway with theneighboring house. As such, it does not interfere with any reasonable development of thelot by the property owner ( we have attached a photo of the tree to illustrate).
Nothing is growing under the tree that it could interfere with (part of a the neighbor's lawngrows under the canopy, but there is no real impact).
The tree is so close to the property line that nearly half of the canopy is over the neighbor'slot, and removal would certainly affect them. There are also four or five houses in the areathat can see the tree from their property that would also be impacted.
There are several large, beautiful oak trees in this section of Love Lane, and they establishthe look and character of this particular neighborhood. None should be removed without avery good reason.
To summarize, there is no condition that would qualify this protected tree for removal, and wetherefore request that you deny the appeal.
