HomeMy WebLinkAbout031621-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council March 16, 2021 SUBJECT: Resolution No. 12-2021, accepting a Grant of Easement for Public Utility Purposes along the north side of Fieldstone Drive at Lot 7, of Subdivision 9479 BACKGROUND On November 19, 2019, the Town Council approved Subdivision 9479 (Edendale), an 18- lot single family residential development located at Sherburne Hills Road and Fieldstone Drive. The portion of the easement for PG&E’s underground utilities on Lot 7 was inadvertently omitted from the final subdivision map. This grant of easement from the developer completes the necessary dedications to accommodate the facilities. DISCUSSION Lot 7 is owned by TH Danville LLC, the developers of Subdivision 9479, Edendale, and have executed the Grant of Easement for Public Utility Purposes document (Attachment B). PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. Williams Assistant Town Manager Attachments: A – Resolution No. 12-2021 B – Grant of Easement for Public Utility Purposes RESOLUTION NO. 12-2021 ACCEPTING A GRANT OF EASEMENT FOR PUBLIC UTILITY PURPOSES ALONG THE NORTH SIDE OF FIELDSTONE DRIVE AT LOT 7, OF SUBDIVISION 9479 WHEREAS, TH Danville LLC constructed public improvements according to the Conditions of Approval for Subdivision 9479; and WHEREAS, a portion of the Public Utility Easement was required on Lot 7 of Subdivision 9479; and WHEREAS, a Grant of Easement has been executed by the property owner to memorialize the public utility easement along Lot 7; and WHEREAS, action by the Town Council is necessary to accept the easement; and WHEREAS, it is in the Town’s best interest to accept the easement; now, therefore, be it RESOLVED, that the Danville Town Council accept the Grant of Easement, as executed by TH Danville LLC; and, be it further RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance to the easement document and have it recorded at the Contra Costa County Recorder’s Office.
