Catherine Davies Comments (Please read after John Davies) Catherine Davies - 16 Fieldstone Drive, Danville. As my husband, John mentioned, throughout this entire ordeal, Trumark has not been transparent or forthcoming about the scope of this project and the impact that it would have on our property in particular. The construction is on a 5 acre site, but unbeknownst to us, our property is the hub of the major construction activity and PG&E connectivity for this new development. In the early discussions with Trumark, we were told there would be a wall built and a drainage basin on the development side of that wall. That is it. We know there will be construction activity, but it was never disclosed to us that there would be massive and continual earthmoving and deep trenching over and over again, day after day, week after week, month after month about 25 feet from our home, and about 2 feet on the opposite side of our fence. They never disclosed to us that all the major piping was going to run along our property; that the gas tie-in was going to be connected at our property, and their plans to put a massive power drop on our property for their 18 home subdivision on a pole that we were told would be removed! All of this undisclosed activity on and next to our property has led to significant damage to our home to over $120,000 in estimated costs to fix damages and clean, and the construction is far from over. Some of these damages include: -Consistent earthquake-level shaking leading to cracks on our outside concrete, indoor floor and ceiling. -Excessive rodent burrowing damage from their habitats being disrupted. -Broken pipes inside and outside. -Shifting in window and door thresholds that will not close properly. -Extreme dirt from the lot being exposed for months. -Overall deterioration of our yard as we wait for the work to be done to do improvements. 1 Not to mention the extreme stress it has placed on us. We have lost all sense of peace and privacy and we have had to deal with continuous disruptions and inconveniences. We have been held hostage in our home - not by the pandemic, but by the construction. Now more than ever, when your home should be your haven, we have not been able to enjoy our yard, outdoor living space, pool/spa. We have had to keep our home closed up because of all the noise and dirt. We can’t leave because we cannot trust the activity around our home. We cannot trust Trumark due to what we’ve encountered. We have been more than patient and accommodating and yet we have had no empathy of what we have been enduring all this time, or assurances from Trumark that they would take care of the damages that they caused. We have tried to have conversions with Trumark about these issues to no avail. They have no regard for us or the regulations that the town has mandated, and the power pole is just one example of many that demonstrates how they will step over us without concern. When we left the May 7, 2019 Town Council meeting, we had the Resolutions providing the rules of construction put in place by the Town for the Trumark Construction. In those resolutions were protections for trees, Indian artifacts, birds/wildlife, but there were no real protections for the residents like us, in the immediate construction area. Also, the resolutions call for rodent control, dirt control, cleaning requirements, construction activities of equipment passing through our neighborhood, work start time requirements. None of these resolutions has been enforced, or just minimally. If there are resolutions in place for protection, but they are not enforced, what good are they? When construction activity is literally feet from a residence, shouldn’t there be protections in place for citizens who live there? We did not ask for this, but we have suffered the consequences of it, both personally and financially. Where is our protection? We would like for the town to put protections in place for us. Thank you. Sent from my iPad 2
