SUBJECT: Resolution No. 71-2020, appropriating funds and authorizing execution of a
contract for third-party review of the revised Stormwater Management Plan
and Drainage Study for the Condominium Project located at 359 & 375 El
Pintado Road (Subdivision 9399)
BACKGROUND
The Address Company has submitted preliminary civil engineering Stormwater Control
Plan for the approved Tentative Map SD 9399 Condominium Project, consisting of a 37-unit
multifamily for rent project located at 359 & 375 El Pintado Road (APN 200-140-012, APN
200-140-011).
DISCUSSION
The applicant has submitted an updated Stormwater Management Plan and Drainage Study
that requires review by an independent third-party consultant. The Town will manage the
consultant expenses associated with the work which will be borne by the project applicant.
The applicant will submit funds to the Town equivalent to the cost of the consultant’s
contract, and the Town will disburse funds consistent with the terms of the contract.
The Town selected Terraphase Engineering, Inc. of Oakland, California as the third-party
consultant for the project. The total contract amount is $10,705.

Posting of the meeting agenda serves as notice to the public.
FISCAL IMPACT
None. All costs associated with the third-party review will be borne by the applicant,
Address Company. Appropriation of funds to pay for the review will not result in a fiscal
impact to the Town.

RECOMMENDATION
Adopt Resolution No. 71-2020, appropriating funds and authorizing execution of a contract
for third party review of the revised Stormwater Management Plan and Drainage Study for
the Residential Condominium Project located at 359 & 375 El Pintado Road.

RESOLUTION NO. 71-2020
APPROPRIATING FUNDS AND AUTHORIZING EXECUTION OF A CONTRACT
FOR THE STORMWATER MANAGEMENT PLAN AND DRAINAGE STUDY FOR
THE CONDOMINIUM PROJECT LOCATED AT 359 & 375 EL PINTADO ROAD
(SUBDIVISION 9399)
WHEREAS, the Town of Danville approved the Condominium Project DEV15-0065
located at 358 & 375 El Pintado Road: and
WHEREAS, the services of a third-party consultant are needed for the Town to plan
check the revised Stormwater Management Plan and Drainage Study for the
development; and
WHEREAS, the applicant is required to pay plan check fees for the revised Stormwater
Management Plan and Drainage Study; and
WHEREAS, after soliciting a proposal for professional third-party review services for the
Stormwater Management Plan and Drainage Study, the Town desires to enter into a
contract for plan review services with Terraphase Engineering, Inc.; now, therefore, be it
RESOLVED, that the Danville Town Council authorizes the Town Manager to execute
an agreement with Terraphase Engineering, Inc. for third party review services; and be it
further
RESOLVED, that $10,705 is appropriated for the review of the Stormwater Control
Management Plan and Drainage Study.
