CALL TO ORDER The special meeting of the Danville Town Council was called to order by Mayor Stepper at 5:00 p.m. The meeting was conducted by teleconference only. 1.1 Roll Call City Clerk Marie Sunseri conducted the roll call for attendance. Present: Karen Stepper, Mayor Lisa Blackwell, Vice Mayor Newell Arnerich, Councilmember Renee Morgan, Councilmember Robert Storer, Councilmember All Councilmembers were present. 1.2 Announcements City Clerk Marie Sunseri provided information regarding the format of the meeting and instructions for public comment. 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Mayor Stepper. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 4. Peter Cedolini, Mangia Mi, expressed concern regarding the plight of restaurants on Hartz Avenue as a result of the street closures and urged the Town to discontinue the temporary weekend street closures. Town Manager Joe Calabrigo responded to public comments. 5. CONSENT CALENDAR Item 5.5 was removed for public comment. 5.1 Consider approval of the Summary of Actions from the special Town Council meeting of September 1, 2020 5.2 Consider approval of the Register of Demands 5.3 Consider acceptance of the July 2020 Month End Treasurer's Report 5.4 Consider adoption of Resolution No. 64-2020, amending the Town of Danville Conflict of Interest Code 5.5 Consider adoption of Ordinance No. 2020-03, adding a new Chapter 5-9 to the Danville Municipal Code regulating sidewalk vendors REMOVED FOR PUBLIC COMMENT 5.6 Consider adoption of Resolution No. 65-2020, approving a Notice of Completion for the Synthetic Turf Replacement Project, CIP No. B-493 MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE THE CONSENT CALENDAR, WITH THE EXCEPTION OF ITEM 5.5 MOTION CARRIED 5-0 2 DocuSign Envelope ID: CFAB7F9A-DC25-49C7-A11 F-8F8FA30643CB DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS SEPTEMBER 15, 2020 ITEM 5.5 - CONSIDER ADOPTION OF ORDINANCE NO. 2020-03, ADDING A NEW CHAPTER 5-9 TO THE DANVILLE MUNICIPAL CODE REGULATING SIDEWALK VENDORS REMOVED FOR PUBLIC COMMENT City Clerk Marie Sunseri read public comment received prior to the meeting: 1. Mary Dunne Rose expressed concern regarding sidewalk vendors on Camino Tassajara and violation of child labor laws, fair employment laws and county health laws, and the spread of coronavirus. She expressed opposition to the vendors directly competing with Danville brick and mortar businesses and requested the Town take steps to stop unlawful and unsanitary behavior. City Attorney Rob Ewing responded to the public comments and stated that the Town is complying with applicable laws in adoption of the Ordinance as presented. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT ORDINANCE NO. 2020-03, ADDING A NEW CHAPTER 5-9 TO THE DANVILLE MUNICIPAL CODE REGULATING SIDEWALK VENDORS MOTION CARRIED 5-0 6. COMMUNICATIONS 6.1 Police Department report by Danville Police Chief Allan Shields Police Chief Allan Shields presented the report. 7. PUBLIC HEARINGS 7.1 Consider introduction of Ordinance No. 2020-04, repealing Ordinance No. 2020-02, which suspended automatic deemed complete and approval deadlines for all land use, subdivision, and zoning applications City Attorney Rob Ewing presented the staff report. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2020- 04, REPEALING ORDINANCE NO. 2020-02, WHICH SUSPENDED AUTOMATIC DEEMED COMPLETE AND APPROVAL DEADLINES FOR ALL LAND USE, SUBDIVISION, AND ZONING APPLICATIONS, AND RETURN FOR SECOND READING ON OCTOBER 6, 2020 MOTION CARRIED 5-0 8. TOWN COUNCIL REPORTS 8.1 Consider appointment of a representative to the Danville Historic Design Review Committee for term ending December 31, 2022 Recommendation: Appoint Heritage Resource/Planning Commission member Mark Graham MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER STORER, TO APPOINT MARK GRAHAM AS THE HERITAGE RESOURCE/ PLANNING COMMISSION REPRESENTATIVE TO THE HISTORIC DESIGN REVIEW COMMITTEE FOR A TERM ENDING DECEMBER 31, 2022 MOTION CARRIED 5-0 8.2 Town Council updates The Mayor and Town Council provided updates on events and activities in the Danville community. 9.
