Dear Town Council,
This public comment is for the Town Council meeting Agenda item September 15, 2020 update to the Town Municipal
Code regarding sidewalk vendors.
This past Sunday on Camino Tassajara there were two children at the ongoing fruit vendors site. One appeared to be
about 13years, the other one 14 or 15 years old. Child labor laws, Fair employment laws are being violated. This is no
little lemonade stand!
This site constantly has a fruit vendor daily for over a month. There is nowhere for them to wash their hands. There are
no bathroom facilities yet they are there from morning till evening handling food. They do not wear facemasks or
gloves. County health laws are violated with this consistent unclean, unhygienic, filthy behavior.
Unsanitary, repeated behaviors that could spread the deadly coronavirus or flu germs onto the fruit or contamination
spread by talking without masks, gloves and social distancing needs to stop. These street vendor food stands are in
violation of County coronavirus prevention and Food Health Department rules.
Do the street vendors post a business license from the town of Danville? Do they have a food distribution permit from
the County health department and are inspected? Are they following all the child labor laws? Are they complying with
minimum wage, payroll tax withholding and payment of said withholding to the government, or California mandatory
break and sick leave law’s, does the owner file annual federal and state income tax returns and pay taxes like the rest of
us, etc.?
Finally, these vendors are directly competing with our Danville brick and mortar businesses which are suffering due to
the pandemic shelter in place rules. Unfair business competition is happening in our town as we ignore the laws. Let’s
help, encourage our businesses that comply with the laws. Let’s stop the lawbreakers!
Respectfully request our Danville Town Council take steps to stop this unlawful, unsanitary behavior
and prevent the spread of all germs, including coronavirus, in our town. Child labor laws, County
health food permitting laws, income tax and fair labor laws need to be complied with regarding
sidewalk vendors.
