HomeMy WebLinkAbout091520-05.4 5.4 ADMINISTRATIVE STAFF REPORT TO: Mayor and Town Council September 15, 2020 SUBJECT: Resolution No. 64-2020, amending the Town of Danville Conflict of Interest Code BACKGROUND The Political Reform Act of 1972 (the "Act") requires that certain government officials and employees designated in the Act (Government Code Section 87200 - see footnote 1 to Exhibit 1) are required to file annual financial disclosure statements. The Act also requires all local agencies to adopt their own local Conflict of Interest Code designating the officials and employees of that agency who participate in the making of decisions which may have a material effect on the financial interests of those officials and employees. DISCUSSION Each local agency must review its local Conflict of Interest Code every two years and make modifications as necessary. It is now time to conduct the biennial review and amend the Code to ensure that the positions listed in the Code are accurately reflected. The following modifications are proposed: delete the Arts Commission; add the Arts Advisory Board; change the name of the Parks and Leisure Services Commission to the Parks, Recreation and Arts Commission; and change the title of Information Systems Manager to Information Technology Manager. No other changes are proposed at this time. Exhibit 1 lists the Town officials and employees subject to the Code. Disclosure categories require reporting all interests. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. Prepared by: Marie Sunseri City Clerk Attachment: Resolution No. 64-2020 Exhibit 1 - Town of Danville Conflict of Interest Code, Section 1 Conflict of Interest Code 2 September 15, 2020 RESOLUTION NO. 64-2020 AMENDING THE TOWN OF DANVILLE CONFLICT OF INTEREST CODE WHEREAS, the Political Reform Act of 1972 (the “Act”) requires every local government agency to adopt a local Conflict of Interest Code; and WHEREAS, the Act requires every local government agency to review its Conflict of Interest Code every two years and make necessary amendments when necessary; and WHEREAS, it is now time to conduct the biennial review of the Conflict of Interest Code; and WHEREAS, the Town formed an Arts Advisory Board, dissolved the Arts Commission, and changed the name of the Parks and Leisure Services Commission, requiring an amendment of the Code and prompting a review of the Code to ensure that all positions listed in the Code are accurately reflected; and WHEREAS, the title of Information Systems Manager was changed to Information Technology Manager to better reflect the duties of the position; now, therefore, be it RESOLVED, by the Danville Town Council that the Town of Danville’s Conflict of Interest Code, consisting of the attached Exhibit 1, is hereby adopted.
