To the Town Counsel -
I am the President of Landmark Oak HOA which includes Tivoli Lane and Promenade Lane. TIvoli Lane shares a fence
with Abigail Place. I am writing to express my extreme frustration with the lack of concern the Town has shown to our
development during the construction of Abigail Place. The Town 2030 General Plan requires: "The positive qualities
that define each neighborhood should be maintained and enhanced, thus enabling the Town to retain its outstanding
quality of life." (See, 2030 General Plan, page 3.30.) There was total disregard for our property during the construction
and this continues. The Town's inspector saw this being done but did nothing to stop it or minimize the
damage. Specifically,
1. A temporary fence was constructed on our property without our permission. In essence, this was Town sanctioned
trespass. Landsea's team nailed the fence to our trees. (See, Attachment 1 with pictures which will be sent
separately.) One of these trees has died and had to be replaced. We hope the Redwoods will survive but at this point,
it is hard to tell. Additionally, the temporary fence often leaned against the trees. (See, Attachment 2 with pictures
which will be sent separately.)
2. The construction of the retaining wall destroyed our irrigation system. (See, Attachment 3 with pictures which will be
sent separately.) The leaks went on for a while and we lost huge amounts of water and had a large EBMUD
bill. Although Landsea did install new irrigation, they did not compensate us for the lost water and we had to do
modifications so that the system worked correctly for this area.
3. This work also destroyed the look and feel of the area. (See, Attachment 4 with pictures of the area before the
construction and Attachment 5 with pictures of the area during construction.) Landsea promised to put mulch down in
this area to replace the mulch and land cover that was there before. Despite repeated emails requesting this, to date,
Landsea has not fulfilled this promise.
4. The fence and retaining walls that Landsea installed have significant problems. Landsea has told us that the fence
and retaining wall have been approved by the Town. This seems quite surprising since there are staples or nails sticking
out of the fence on our side of the fence which is incredibly dangerous. (See, Attachment 6 with pictures which will be
sent separately.) The retaining wall has exposed bolts which look dangerous and the mud and cement on the fence have
not been cleaned up. (See, Attachment 7 with pictures which will be sent separately.)

5. Most recently, Landsea arranged for the raised cross-walk to be installed. I was told by the Landsea Foreman that the
Town gave them permission to cut our bushes and damage the irrigation in this area. (See, Attachment 8 with pictures
which will be sent separately.)
We are disappointed that Landsea did not treat our property with the same amount of respect that it treated its
property and that the Town did not require that. Our property has been damaged and looks worse than before the
construction started. The 2030 General Plan's requirement that "each neighborhood should be maintained and
enhanced" has not been followed. We request that the Town ensure that the damage that has been caused to our
property be fixed to our reasonable satisfaction before any final occupancy permits are issued and that funds in escrow
be held to ensure that the Redwoods actually survive.
