HomeMy WebLinkAbout072120-05.9 ADMINISTRATIVE STAFF REPORT 5.9 TO: Mayor and Town Council July 21, 2020 SUBJECT: Resolution No. 57-2020, authorizing the Mayor of the Town of Danville to certify the Measure J Calendar Years 2018 and 2019 Growth Management Program Compliance Checklist BACKGROUND The Measure J Calendar Years 2018 and 2019 Growth Management Program Compliance Checklist (“Compliance Checklist”) consists of the eighth and ninth years of Measure J (calendar years 2018 and 2019). As with the previous requirements under Measure C, Measure J requires that local jurisdictions in Contra Costa County take several actions in order to receive the 18% Local Street Maintenance and Improvement (“return-to-source”) funds for FY 2019/20 and FY 2020/21: 1.Implementation of actions, measures and programs agreed upon in the Tri- Valley Transportation Plan/Action Plan for Routes of Regional Significance; 2.Adoption of a development mitigation program to ensure that new development pays its fair share of the costs associated with that development and that no funds from the Measure will be used in place of private developer funding; 3.Implementation of a regional transportation mitigation program (Southern Contra Costa Regional Fee and the Tri-Valley Transportation Development Fee); 4.Development of an implementation program, based upon the Capital Improvement Program and Housing Element, that creates housing opportunities for all income levels; 5.Participation in cooperative, multi-jurisdictional planning to ease cumulative traffic impacts. This is accomplished through regular attendance and participation at the Southwest Area Transportation Committee (SWAT), the local Regional Transportation Planning Committee (RTPC) created by Measure C and continued under Measure J; Measure J Calendar Years 2018 and 2019 GMP Compliance Checklist 2 July 21, 2020 6.Adoption of a five-year Capital Improvement Program to meet and maintain adopted traffic service and performance standards; 7.Adoption of a Transportation Demand Management (TDM) Ordinance; 8.Adoption of, and compliance with, a voter-approved Urban Limit Line (ULL). 9.Posting of signs meeting Authority specifications for all projects exceeding $250,000 that are funded, in whole or in part, with Measures C and J funds; 10.Adoption of, and compliance with, a Growth Management Element (GME); 11.Maintenance of a specified minimum level of local street and road expenditures based on a historic amount spent for transportation during a base period; and 12.Submittal of a Local Street Maintenance and Improvement (LSM) report on Measure J expenditures for FY 2017/18 and FY 2018/19. Each jurisdiction is required to submit a Compliance Checklist (Attachment B) to the Contra Costa Transportation Authority (“Authority”) to demonstrate how it complies with the requirements of Measure J. Upon approval of the Compliance Checklist, the Authority uses a “population and road miles” formula, based upon the California Department of Finance’s population estimates and Caltrans’ public road mileage data to allocate funds to each local agency. The Authority distributed $853,034 in return-to-source funds to Danville for FY 2018/19. Based on a revenue and allocation report released by the Authority in December 2019 (Attachment C), an amount of $807,459 was forecast to be distributed to Danville for FY 2019/20. However, due to the COVID-19 pandemic Measure J revenues will be significantly reduced. The Authority has indicated that revenue forecasts will be updated in fall 2020. DISCUSSION The Town of Danville is in full compliance with the Measure J Growth Management Program (GMP). Dating back to 1985, before the passage of Measure C in 1988, the Town Council was in the process of implementing growth management in Danville. Although Measure C required some formalization and reformatting of growth management efforts within the Town, Danville’s established practices were already consistent with Measure C efforts. On April 1, 2009, the Measure J program commenced and elements of the Countywide GMP compliance reporting requirements were modified from previous Measure C requirements. Highlights of Danville’s compliance during calendar years 2018 and 2019 are detailed in Attachment B. Measure J Calendar Years 2018 and 2019 GMP Compliance Checklist 3 July 21, 2020 PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT Following Authority certification of compliance, the Town was expected to receive an estimated $807,459 for FY 2019/20 per revenue estimates provided by the Authority in December 2019 (Attachment C). As previously described, the Authority plans to update their revenue forecasts in fall 2020. In adopting the 2020/21 Operating Budget, the Town forecast revenue of $566,149 for the fiscal year. RECOMMENDATION Adopt Resolution No. 57-2020, authorizing the Mayor of the Town of Danville to certify the Measure J Calendar Years 2018 and 2019 Growth Management Program Compliance Checklist. In addition, the Town served on several Contra Costa Transportation Authority (CCTA) committees including the CCTA Board, Technical Coordinating Committee (TCC), and Growth Management Program Task Force. The Town continued collection of the Southern Contra Costa County (SCC) Regional and Sub-Regional Fees, and the Tri-Valley Transportation Development Fee (TVTDF) for traffic mitigation. These fee programs meet the objectives of mitigating impacts of new development on the regional on the roadway system and objectives set forth in the Tri- Valley Transportation Plan and Action Plan (TVTP/AP). The Town also actively participated in efforts related to an update to the Tri-Valley Transportation Council’s (TVTC) Nexus Study update for the Tri-Valley Transportation Development Fee (TVTDF) Program. The Town actively participated on the Dougherty Valley Transit Oversight Committee. The Town monitored Level of Service performance at 31 intersections, and measured traffic volumes at 31 locations through its biennial traffic count program. The TVTP/AP identifies “Interregional” (pre-existing Routes of Regional Significance) and “Intraregional” (local roads) Routes of Regional Significance throughout the Tri-Valley region, and the establishment of Multimodal Transportation Service Objectives (MTSO’s) for the purpose of measuring performance and quality of service along these routes. The Town’s analysis of its traffic count data confirmed that all “Intraregional” routes met the established MTSO’s, inclusive of meeting acceptable Level of Service thresholds at monitored intersections. Partnering with the City of San Ramon and Contra Costa County, the Town continued to participate in the TRAFFIX Student Transportation Program for the San Ramon Valley, a traffic congestion relief program funded through Measure J. Project was determined to be in accordance with Tri-Valley Transportation Plan/Action Plan objectives. ▪301 Hartz Avenue, DEV19-0011, Resolution No. 2019-10: Construction of 2,506 second-story addition (commercial). The project was determined to be in accordance with Tri-Valley Transportation Plan/Action Plan objectives. 2.Development Mitigation Program a.Describe progress on implementation of the regional transportation mitigation program: The Town collects two regional transportation mitigation fees; the Southern Contra Costa (SCC) Regional/Sub-regional Fees and the Tri-Valley Transportation Development Fees (TVTDF) for traffic mitigation. In 2019, the TVTC initiated an update to the TVTDF Nexus Study. Otherwise, list the resolution number and date of adoption of the most recent five-year CIP. The Town of Danville approved the 2020/21 Operations Budget and five-year Capital Improvement Program (CIP) on June 16, 2020 via Resolution 36-2020. The Town of Danville’s TSM ordinance was adopted on December 16, 1997 via Resolution No. 97-10 and is provided as Attachment 7. 8.Adoption of a voter-approved Urban Limit Line The local jurisdiction’s adopted ULL is on file at the Authority offices. Please specify any actions that were taken during the reporting period with regard to changes or modifications to the voter-approved ULL, which should include a resolution making a finding of consistency with Measure J and a copy of the related public hearing notice. On February 6th, 2007, via Resolution No. 8-2007, the Town of Danville approved the County’s approved Measure J Urban Limit Line (ULL) as the Town’s adopted ULL for the purpose of compliance with Measure J to establish a voter approved ULL.
