HomeMy WebLinkAbout072120-05.7 ADMINISTRATIVE STAFF REPORT 5.7 TO: Mayor and Town Council July 21, 2020 SUBJECT: Resolution No. 55-2020, approving a Notice of Completion for the Sycamore Valley Park Drainage Improvements Project, CIP No. B-611 BACKGROUND In the past, existing drainage facilities at Sycamore Valley Park have been routinely overwhelmed by storm runoff. CIP B-611 upgraded the existing drainage system to withstand larger storm events and prevent future mud and silt runoff. The new drainage improvements will prevent the existing system from becoming overwhelmed, capturing the mud and silt, while allowing water runoff to be drained away through the existing storm drain system. DISCUSSION The project is now complete and ready for acceptance by the Town. All work was performed in accordance with the approved plans and specifications. The original contract amount of $74,112.50 was decreased by $3,387.00 as a result of one Contract Change Order. The change order consisted of adjustment of final bid quantity measurements. The final contract amount of $70,725.50 (contract plus change orders) is within the authorized construction budget for this project. B-611 WHEREAS, on February 4, 2020, the Town of Danville awarded a construction contract to Grade Tech, Inc., for the Sycamore Valley Park Drainage Improvements Project, CIP No. B-611; and WHEREAS, the City Engineer has determined that the work under this project has been completed as of May 26, 2020, in accordance with the plans and specifications thereof; and WHEREAS, California Civil Code section 9204 specifies the requirements for recordation of a Notice of Completion; and WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice of Completion is recorded the Town must release all undisputed retention payments to the contractor; now, therefore, be it RESOLVED, by the Danville Town Council that said work by and with Grade Tech, Inc., is hereby accepted as complete; and, be it further RESOLVED, that the City Clerk is hereby authorized and directed to file with the County Recorder of the County of Contra Costa, a Notice of Completion for said project within fifteen (15) days from the date hereof; and, be it further RESOLVED, that undisputed retention payments be released in accordance with Sections 8812 and 9356 of the California Civil Code. Jones, City Engineer Date RCE #69367 Town of Danville ATTACHMENT B RESOLUTION NO. 6-2020 AWARDING A CONSTRUCTION CONTRACT FOR SYCAMORE VALLEY PARK DRAINAGE IMPROVEMENTS PROJECT, CIP NO. B-611 WHEREAS, the plans and specifications for the Sycamore Valley Park Drainage Improvements Project, CIP No. B-611 have been reviewed and approved by the City Engineer; and WHEREAS, the City Clerk of this Town did, in open session on the 21st day of January 2020, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the lowest responsive bidder is Grade Tech, Inc., of San Ramon CA, at $74,112.50, the City Engineer has recommended awarding a construction contract for the project to said contractor; and WHEREAS, sufficient funds have been appropriated in the Capital Improvement Program for CIP B-611 – Sycamore Valley Park Drainage Improvements; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the construction contract for the Sycamore Valley Park Drainage Improvements Project, CIP No. B-611 to Grade Tech, Inc., of San Ramon, CA; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Grade Tech, Inc., of San Ramon, CA, for $74,112.50 and authorize use of a 25% contingency of $18,528.13 for a total construction budget of $92,640.63 for work in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the Town shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
