RESOLUTION NO. 44-2020
ACCEPTING EASEMENTS FOR PUBLIC ACCESS PURPOSES (SAN RAMON
CREEK PEDESTRIAN BRIDGE)
WHEREAS, MM Danville Apartments, LLC, ("Owner") is the owner of real property
located at 373 Diablo Road (APN 216-120-037), which it is currently improving with the
Alexan apartment project; and
WHEREAS, conditions of approval for the project require Owner to dedicate public
access easements across the property from Diablo Road to the new pedestrian bridge
which will cross San Ramon Creek; and
WHEREAS, the Town's engineering staff has reviewed and approved the offer of
dedication for the necessary easements; and
WHEREAS, action by the Town Council is necessary to accept the easements; now,
therefore, be it
RESOLVED, that the Danville Town Council accepts the Irrevocable Offer to Dedicate
Easements for Public Access Purposes as offered by MM Danville Apartments, LLC; and,
be it further
RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance
to the easement document and have it recorded at the Contra Costa County Recorder's
Office.
APPROVED by the Danville Town Council at a special meeting on June 16, 2020 by the
following vote:
AYES: Arnerich, Blackwell, Morgan, Stepper, Storer
